TJD-AD 2018-096 Disciplinary Decision - Football
September 26, 2018
On 26 September 2018 the Brazilian Sports Justice Anti-Doping Tribunal (TJD-AD) decided to impose a 6 month period of ineligibility on the football player after he tested positive for the prohibited substance Cocaine he had used 5 days before the competition.
Hereafter in November 2018 the Brazilian Doping Control Authority (ABCD) appealed this decision with the TJD-AD Appeal Tribunal. ABCD accepted that the violation was not intentional, yet contended that the reduced sanction was incorrect and not in accordance with the Rules.
The TJD-AD Rapporteur agrees that the imposition of a sanction of 6 months in First Instance was erroneous and that under the Rules a reduced sanction of 12 months is appropriate.
Therefore the TJD-AD Appeal Panel decides on 20 December 2018 to ammend the Appealed Decision an to impose a 12 month period of ineligibility on the Athlete, starting on the date of the sample collection, i.e. on 11 March 2018.
