Facts
The French Federation of Workers and Amateurs in sports (Fédération Sportive et Gymnique du Travail (FSGT) charges respondent M19 for a violation of the Anti-Doping Rules. During a power lifting contest on June 2, 2007, a sample was taken for doping test purposes. The analysis showed the presence of prednisone and prednisolone. Prednisone and prednisolone are prohibited substances according the World Anti-Doping Agency (WADA) prohibited list and are regarded as specified substances.

History
The respondent used medication to treat his asthma, from which he suffers since childhood. He has proof of his medical condition. His medication however is only needed when his condition is in a crisis. There still is a medical justification necessary to use this kind of medication.

Decision
1. The sanction is a period of ineligibility of one year in which respondent can't take part in competition or manifestations organized or authorized by French sport federations organized or authorized by the FSGT or the French Federation of Weightlifting, Fitness, Powerlifting and Bodybuilding (FFHMFAC).
2. The decision dated November 20, 2007, by the disciplinary committee of the FSGT should be modified.
3. The period of ineligibility will be reduced by the time already served in voluntary suspension and under the decision dated November 20, 2007, by the disciplinary committee of the FSGT.
4. The present decision will start on the date of notification.
5. The decision will be published and sent to the parties involved.

AFLD 2008 FFC vs Respondent M18

Facts
The French Cycling Federation (Fédération Française de Cyclisme, FFC) charges respondent M18 for a violation of the Anti-Doping Rules. During a cycling event on May 18, 2007, a sample was taken for doping test purposes. The analysis of the sample showed the presence of prednisone and prednisolone, which are prohibited substances according the World Anti-Doping Agency (WADA) prohibited list. These are regarded as specified substances.

History
The respondent uses medication to treat asthma, this medication is the cause of the positive test. The respondent has reports to prove his medical state. However the panel doesn't recognize that the medication subscribed treated what he was suffering from on behalf of the documents he presented.

Decision
1. The sanction is a period of ineligibility of one year in which the respondent can't take part in competition or manifestations organized or authorized by all French sport federations.
2. The decision at first instance (6 months period of ineligibility) dated October 4, 2007, by the disciplinary committee of the FFC should be modified.
3. The period of ineligibility should be reduced by the time already served by the earlier decision from the disciplinary committee of the FFC.
4. The decision starts on the date of notification.

The French Federation of American Football (Fédération Française de Football Américain, FFFA) charges respondent M17 for a violation of the Anti-Doping Rules. During a match on May 6, 2007, a sample was taken for doping control purposes. The analysis showed the presence of a metabolite of cannabis. Cannabis is a prohibited substance according the World Anti-Doping Agency (WADA) prohibited list and is regarded as a specified substance.

History
The respondent didn't provide any explanation about how the prohibited substance had entered his body. However cannabis is a prohibited substances when used in competition although the panel does realize it wasn't used to enhance sport performance.

1. The sanction is a period of ineligibility of five months in which respondent can't take part in competition or manifestations organized or authorized by the FFFA.

The French Tennis Federation (Fédération Française de Tennis, FFT) charges respondent M16 for a violation of the Anti-Doping Rules. During a match on June 23, 2007, the respondent was summoned to provide a sample for doping control purposes. The respondent didn't attend the doping control.

History
THe doctor sampler provides a finding of non-attendance in control against respondent because he was unable to locate him after the match. The responded had waited but left because returning to the place where he stayed was 1 hour en 20 minutes by car. However the respondent is an experienced player and aware of the rules regarding doping controls.

During an event on January 20, 2007, respondent didn't attend the doping control.

FEI 2008 FEI vs Daniel Pinto

Facts
The International Equestrian Federation (FEI) alleges Daniel Pinto (the athlete) for a violation of the Anti-Doping Rules of Human Athletes. The athlete took part in the CDI-W London Olympia, GBR, 17-22 december 2007 he provided urine sample during an in-competition doping test on 17 December 2007. His sample contained 11-nor-delta-9-tetrahydrocannabinol-9-carboxylic acid
(Marijuana).

History
Ten days before the game, he attended a social event in Seville, Spain, where other people started smoking a cigarette of marijuana. The Athlete decided to smoke it too. The athlete had no intention to enhance his performances.

Decision
1. As a result of the foregoing, the Tribunal has decided to disqualify the Athlete from the Event and that all medals, points and prize money won at the Event must be forfeited, in accordance with ADRHAs Article 9.
2. As a consequence of the foregoing, the FEI Tribunal decides to impose on the Athlete the following sanctions, in accordance with GR Article 174 and ADRHA Article 10: The Athlete shall be suspended for a period of three (3) months to commence immediately and without further notice at the expiration of the period in which an appeal may be filed (30 days from the date of notification of the written decision) or earlier if the appeal is waived in writing by or on behalf of the Athlete.

Abstract

Tribulus terrestris is a nutritional supplement highly debated regarding its physiological and actual effects on the organism. The main claimed effect is an increase of testosterone anabolic and androgenic action through the activation of endogenous testosterone production. Even if this biological pathway is not entirely proven, T. terrestris is regularly used by athletes. Recently, the analysis of two female urine samples by GC/C/IRMS (gas chromatography/combustion/isotope-ratio-mass-spectrometry) conclusively revealed the administration of exogenous testosterone or its precursors, even if the testosterone glucuronide/epitestosterone glucuronide (T/E) ratio and steroid marker concentrations were below the cut-off values defined by World Anti-Doping Agency (WADA). To argue against this adverse analytical finding, the athletes recognized having used T. terrestris in their diet. In order to test this hypothesis, two female volunteers ingested 500 mg of T. terrestris, three times a day and for two consecutive days. All spot urines were collected during 48 h after the first intake. The (13)C/(12)C ratio of ketosteroids was determined by GC/C/IRMS, the T/E ratio and DHEA concentrations were measured by GC/MS and LH concentrations by radioimmunoassay. None of these parameters revealed a significant variation or increased above the WADA cut-off limits. Hence, the short-term treatment with T. terrestris showed no impact on the endogenous testosterone metabolism of the two subjects.

In February 2008 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Corina Dumbrӑvean after her sample tested positive for the prohibited substance NESP - Novel Erythropoiesis Stimulating Protein - (Darbepoetin).

The ANAD Hearing Commission considered the filed statements and evidence that in November 2011 the Athlete suffered from an acute renal deficiency, low output of urine, with unconsciousness for which the Athlete was hospitalized urgently. As medical treatment medications were administrated which contained prohibited substances. The Commission ruled that the Athlete established her lack of guilt or significant negligence due to the fact that she did not know and did not suspect that prohibited substances were administrated.

Therefore on 19 February 2008 the ANAD Sanction Committee decided (case 5/19.02.2008) not to impose a period of ineligibility on the Athlete.

ISR 2007 KNAU Decision Disciplinary Committee 2007049 T

Facts
The Royal Dutch Athletics Association (Koninklijke Nederlandse Atletiek Unie, KNAU) reported a violation of the Anti-doping Code (ADC). His urine sample taken during a doping test was positive for the a metabolite of stanozolol which is on the list or prohibited substances. Also the B sample tested positive.

History
The athlete was unaware of the cause of contamination. He had sent a few products for testing to the RIVM for examination, and on of these products which was used to treat muscle pain contains a metabolite of stanozolol.

Decision
The disciplinary committee will impose a period of ineligibility of two years commencing on the date of the doping control.
The legal costs and fees will be borne by the athlete.

During a match on June 23, 2007, the respondent provided a sample for doping control purposes. The analysis of the sample revealed the presence of a metabolite of cannabis. Cannabis is a prohibited substance according the World Anti-Doping Agency (WADA) prohibited list and is regarded as a specified substance.

History
Respondent had smoked cannabis the evening before the match. He had used the cannabis in a recreation setting, there was no intention to enhance sport performance. Also he doesn't practice the sport as a professional.
