The World Anti-Doping Code International Standard for the Protection of Privacy and Personal Information is a mandatory International Standard developed as part of the World Anti-Doping Program. It was developed in consultation with Signatories, public authorities, and other relevant stakeholders.

A revised version was approved by the WADA Executive Committee at the World Conference on Doping in Sport in Katowice on 7 November 2019 and is effective as of 1 January 2021.

The purpose of the International Standard for the Protection of Privacy and Personal Information is to ensure that Anti-Doping Organizations apply appropriate, sufficient and effective privacy protections to the Personal Information they Process when conducting anti-doping programs, in recognition of the fact that Personal Information gathered in the anti-doping context can impinge upon and implicate the privacy rights of Persons involved in and associated with organized sport.

The Code, in particular, requires Athletes to furnish a significant amount of Personal Information to Anti-Doping Organizations. As a result, it is essential that Anti-Doping Organizations appropriately protect the Personal Information that they Process both to meet legal standards and to ensure the continued confidence and trust of those involved in organized sport.

The Code recognizes and affirms the importance of ensuring that the privacy rights of Persons subject to anti-doping programs based on the Code are fully respected. In support of this commitment, this International Standard sets forth a minimum, common set of rules to which Anti-Doping Organizations must conform when Processing Personal Information pursuant to the Code. In some cases, Anti-Doping Organizations may be required by applicable laws to apply rules or standards that exceed those set forth in this International Standard.

The World Anti-Doping Code International Standard for the Protection of Privacy and Personal Information is a mandatory International Standard developed as part of the World Anti-Doping Program. It was developed in consultation with Signatories, public authorities, and other relevant stakeholders.

A revised version to come into force on 1 January 2021 was approved by the WADA Executive Committee at the World Conference on Doping in Sport in Katowice on 7 November 2019. Following a limited supplementary consultation period, a further revised version was approved by the WADA Executive Committee on 15 September 2020 and is effective as of 1 January 2021.

The purpose of the International Standard for the Protection of Privacy and Personal Information is to ensure that Anti-Doping Organizations apply appropriate, sufficient and effective privacy protections to the Personal Information they Process when conducting anti-doping programs, in recognition of the fact that Personal Information gathered in the anti-doping context can impinge upon and implicate the privacy rights of Persons involved in and associated with organized sport.

The World Anti-Doping Code International Standard for Therapeutic Use Exemptions (TUE) is a level 2 mandatory International Standard developed as part of the World Anti-Doping Program.

The basis for the development of the International Standard for TUE has been a review of various procedures and protocols of International Federations, the IOC, National Anti-Doping Organizations and relevant sections in the revised International Standard for Doping Control (ISDC). A WADA expert reference group reviewed, discussed and prepared the document following wide consultation and consideration of submissions.

The official text of the International Standard for Therapeutic Use Exemption shall be maintained by WADA and shall be published in English and French. In the event of any conflict between the English and French versions, the English version shall prevail.

The International Standard for TUE (version 3.0) will come into effect on 1 January 2009.

The purpose of the International Standard for Therapeutic Use Exemptions is to ensure that the process of granting therapeutic use exemptions is harmonized across sports and countries.

The Code permits Athletes to apply for therapeutic use exemptions (TUE The International Standard for ) i.e. permission to use, for therapeutic purposes, substances or methods contained in the List of Prohibited Substances or Methods where Use would otherwise be prohibited.

TUE includes criteria for granting a TUE, confidentiality of information, the formation of Therapeutic Use Exemptions Committees and the TUE.

This Standard applies to all Athletes as defined by and subject to the Code i.e. able-bodied Athletes and Athletes with disabilities.

The International Standard for Therapeutic Use Exemptions was first adopted in 2004 and became effective in 2005. The enclosed represents version 5.0 that incorporates revisions to the International Standard for Therapeutic Use Exemptions that were approved by the World Anti-Doping Agency Executive Committee on 18 September 2010. The revised International Standard for Therapeutic Use Exemptions is effective as of 1 January 2011.

The purpose of the International Standard for Therapeutic Use Exemptions is to ensure that the process of granting therapeutic use exemptions is harmonized across sports and countries.

The International Standard for Therapeutic Use Exemptions was first adopted in 2004 and came into effect 1 January 2005. Further revisions were made in 2009, 2010 and 2011. The enclosed ISTUE incorporates revisions to the ISTUE and was approved at the World Conference on Doping in Sport in Johannesburg by the WADA Executive Committee on 15 November 2013. It will come into effect on 1 January 2015.

The International Standard for Therapeutic Use Exemptions is a mandatory International Standard developed as part of the World Anti-Doping Program.

The purpose of the International Standard for Therapeutic Use Exemptions is to establish
(a) the conditions that must be satisfied in order for a Therapeutic Use Exemption (or TUE) to be granted, permitting the presence of a Prohibited Substance in an Athlete’s Sample or the Athlete’s Use or Attempted Use, Possession and/or Administration or Attempted Administration of a Prohibited Substance or Prohibited Method for therapeutic reasons;
(b) the responsibilities imposed on Anti-Doping Organizations in making and communicating TUE decisions;
(c) the process for an Athlete to apply for a TUE;
(d) the process for an Athlete to get a TUE granted by one Anti-Doping Organization recognized by
another Anti-Doping Organization; (e) the process for WADA to review TUE decisions; and (f) the strict confidentiality provisions that apply to the TUE process.

The International Standard for Therapeutic Use Exemptions was first adopted in 2004 and came into effect 1 January 2005. Further revisions were made in 2009, 2010, 2011, 2015, and 2018. The enclosed ISTUE incorporates revisions approved by the WADA Executive Committee on 20 September 2018. It will come into effect on 1 January 2019.

The Agency has revised certain templates relating to other Standards that Anti-Doping Organizations (ADOs) may use in conducting their anti-doping program activities. Most templates sit at the model guidelines level of the World Anti-Doping Program. These guidelines are not mandatory but offer technical guidance to ADOs in the implementation of their programs. The Therapeutic Use Exemption (TUE) application form template, which includes the “athlete’s declaration”, is currently an annex to the ISTUE and therefore any changes made to it require approval from the ExCo.

In the interest of ensuring that only key changes to International Standards are put forward for ExCo approval moving forward, the TUE application form has now been removed as an annex to the ISTUE and placed at the model guidelines level along with other guidance tools for ADOs.

Please note below the summary of changes to the revised ISTUE:

1. Page 1 has been updated to 2019 version
2. Annex 2 - TUE application form template has been removed

- Article 6.1 of the ISTUE stipulates that the TUE application form must be based on WADA’s template. It may be modified by ADOs to include additional requests for information, but no sections or items may be removed.

3. Minor change under Article 6.1 where it is mentioned that the template will be available on the WADA website
4. The table of contents has been modified to reflect the removal of the TUE application form template

The World Anti-Doping Agency (WADA) had published the Court of Arbitration for Sport’s (CAS’s) 186-page full reasoned decision regarding its 17 December 2020 ruling in favor of WADA to declare the Russian Anti-Doping Agency (RUSADA) non-compliant with the World Anti-Doping Code for a period of two years and to impose a range of associated consequences. This publication, which was also made on the CAS website, is in keeping with Article 10.4.1 of the 2018 version of the International Standard for Code Compliance by Signatories (ISCCS).

Further to WADA’s media release of 17 December, the Agency has also drafted a legal note that it shares today, which outlines the background leading to the CAS proceedings, provides a summary of the parties’ key arguments, and summarizes the CAS decision.

This CAS decision relates specifically to the manipulation of Moscow Laboratory data by the Russian authorities before and while the data were being forensically copied by WADA’s Intelligence and Investigations Department in January 2019 as part of Operation LIMS. This manipulation was in clear contravention of critical criteria set by WADA’s Executive Committee when RUSADA was reinstated as compliant, under strict conditions, in September 2018.

The CAS decision does not relate to the broader Russian doping crisis dating back to 2014 before WADA was authorized to carry out investigations and before it had the proper legal basis to pursue this matter under the ISCCS.
