In February 2008 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Corina Dumbrӑvean after her sample tested positive for the prohibited substance NESP - Novel Erythropoiesis Stimulating Protein - (Darbepoetin).

The ANAD Hearing Commission considered the filed statements and evidence that in November 2011 the Athlete suffered from an acute renal deficiency, low output of urine with unconsciousness for which the Athlete was hospitalized urgently. As medical treatment medications were administrated which contained prohibited substances. The Commission ruled that the Athlete established her lack of guilt or significant negligence due to she did not know and did not suspected that she was administered prohibited substances.

Therefore on 19 February 2008 the ANAD Sanction Committee decided (case 5/19.02.2008) not to impose a period of ineligibility on the Athlete.

In March 2008 the Federația Română de Atletism (FRA), the Romanian Athletics, appealed against case 5/19.02.2008) with the ANAD Appeal Commission. The FRA argued that in this case 5/19.02.2008 the IAAF anti-doping rules had been disregarded.
On 23 May 2008 the ANAD Appeal Commission (appeal case 2/23.05.2008) ruled that the RAF appeal is admissible and decided to annul the decision (case 5/19.02.2008) of the ANAD Sanction Committee.

The Athlete’s file was submitted to the IAAF Doping Review Board which investigated the case and concluded in August 2008 that there were no exceptional circumstances for the reduction or elimination of the Athlete’s sanction. As a result the ANAD Sanction Committee decided on 10 September 2008 to impose a 2 year period of ineligibility on the Athlete (case 22/10.09.2008).

The Athlete and the Olimpic Sport Club in Craiova appealed against the decision in this case 22/10.09.2008, which was hereafter dismissed by the ANAD Appeal Commission on 8 December 2008 (appeal case 6/8.12.2008).

CAS 2010_A_2173 IAAF vs Romanian Athletics Federation & Anca Heltne - Settlement

CAS 2010/A/2173 the International Association of Athletics Federation (IAAF) vs the Romanian Athletics Federation (RAF) & Ms Anca Heltne (Settlement Agreement)

In February 2010 an anti-doping rule violation was reported against the Romanian Athlete Anca Heltne after her sample tested positive for the prohibited substance stanozolol.

On 4 August 2010 the parties involved agreed that the case CAS 2010/A/2173 shall be withdrawn on the following terms:

1.) The Athlete accepts the positive tested sample collected at the Romanian National Championships in Bucharest on 27 February 2010.

2.) The Athlete accepts that she committed an anti-doping rule violation.

3.) The Athlete accepts a 2 year period of ineligibility, imposed by the IAAF, starting on 1 April 2010.

4.) The Athlete’s results at the 2010 National Championships are disqualified including forfeiture of all titles, awards, medals, points and prize and appearance money.

5.) The Athlete’s results in any competition in which she competed after the 2010 National Championships are also disqualified including forfeiture of all titles, awards, medals, points and prize and appearance money.

6.) The Athlete agrees not to commence or continue proceedings in any forum against the IAAF or the Romanian Athletics Federation (RAF) arising out of the administration of the doping control and the positive tested sample, collected on 27 February 2010, or relating to the imposition of any sanctions in connection therewith.

ANAD Comisia de Apel 2012_01 Domokos Balogh vs ANAD

On 16 September 2010 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, decided to impose a 2 year period of ineligibility on the Athlete Domokos Balogh after his sample tested positive for the prohibited substance testosterone with a T/E ratio above the WADA threshold (case 31/16.09.2010). Research of the Athlete’s supplements showed that the food supplement he used contained the prohibited substance testosterone.
The Athlete’s appeal against this decision was dismissed by the ANAD Appeal Commission on 9 December 2010 (appeal case 10/09.12.2010).

Hereafter in January 2011 the Athlete appealed the decision of the ANAD Appeal Commission (appeal case 10/09.12.2010) with the Romanian Administrative Appeal Court in Cluj instead with the Court of Arbitration for Sport (CAS) in Switzerland.
The Athlete requested the Court in Cluj for the annulment of the decision of his ANAD case 31/16.09.2010 and the appeal case 10/09.12.2010 and only to issue only a reprimand for his his violation.
During the appeal proceedings with the Apeal Court in Cluj, the Athlete’s suspension was lifted by the Court on 6 May 2011.

On 5-6 June 2011 the Athlete participated in the National Championship for Master of the Romanian Bodybuilding and Fitness Federation which ANAD considered this a violation of the imposed 2 year period of ineligiblilty as decided on 16 September 2010 (case 10/09.12.2010).

The Romanian National Anti-Doping Agency appealed with the Romanian High Court of Cassation and Justice against the decision of the Appeal Court of Cluj of 6 May 2011 to lift the Athlete’s suspension, which decided on 24 November 2011 to dismiss the decision of the Appeal Court in Cluj.
After reopening the Athlete’s case the Appeal Court in Cluj decided on 6 April 2012 to dismiss the Athlete’s appeal.

On 15 May 2012 the ANAD Hearing Commission (case 13/15.05.2012) decided, due to the Athlete’s violation of sanction, to set a new start on 5 June 2011 of the imposed 2 year period of ineligibility: the day of the Athlete’s participation to the bodybuilding championship.

Again the Athlete appealed the Decision of the ANAD Hearing Commission (case 13/15.05.2012) with the ANAD Appeal Commission (appeal case 1/29.08.2012).
The ANAD Appeal Commission reviewed the case and concludes that the Appeal Court in Cluj decided ex oficio to lift the Athlete’s suspension on 6 May 2011 without the request of the Athlete.
Nevertheless the Appeal Commission finds that it can’t be established that the Athlete was suspended from 6 May 2011 (decision of the Appeal Court of Cluj) until 24 November 2011 (decision of the High Court of Cassation and Justic) and therefore violated the anti-doping rules when the Athlete participated to the National bodybuilding championship.

On 29 August 2012 the ANAD Appeal Commission decides that:
- the Athlete’s appeal is admissible;
- to annul the decision of the ANAD Hearing Commission (case 13/15.05.2012);
- to start the Athlete’s period of ineligibility on 16 September 2010 (as decided in case 31/16.09.2010);
- from 6 May 2011 until 24 November 2011 the Athlete’s ineligibility was lifted by the Appeal Court in Cluj;
- the ineligibility was resumed on 24 November 2011 until the terminination of the initial ineligibility.

ANAD Comisia de Apel 2010_04 Angela Raluca Rӑducu vs ANAD

In 24 November 2009 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, decides to impose a 2 year period of ineligibility on the Athlete Angelica Raluca Rӑducu after her A and B samples tested positive for the prohibited substance stanozolol.

Hereafter in February 2010 the Athlete appealed the decision of the ANAD Hearing Commission with the ANAD Appeal Commission.
The Athlete argued that she was of good-will, had no intention to enhance her sport performance and requested to start the imposed period of ineligibility on the date of the sample collection instead of the date of the decision.

The ANAD Appeal Commission finds that the Athlete didn’t explain how the prohibited susbstance entered her body; used the substance in order to get more muscles for bodybuilding; and failed to establish the lack of significant guilt or negligence in this case.
Therefore on 8 April 2010 the ANAD Appeal Commission decides to dismiss the Athlete’s appeal and to uphold the decision of the ANAD Hearing Commission of 24 November 2009.

ANAD Comisia de Audiere 2010_10 ANAD vs Cristian Anghel

In November 2009 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Cristian Anghel after he refused to sign the invitation to provide a sample for drug testing. After notification the Athlete failed to attend the hearing of the Commission.
Therefore the ANAD Hearing Commission decides on 23 February 2010 to impose a 2 year period of ineligibility on the Athlete, starting on the date of the decision.

ANAD Comisia de Audiere 2010_09 ANAD vs Ioan Moldovan

In September 2009 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Ioan Moldovan after his sample tested positive for the prohibited substance testosterone with a T/E ratio above the WADA threshold. After notification the Athlete filed a statement in his defence and did not request the B sample analysis.
The ANAD Hearing Commission considers that this is the Athlete’s second violation and therefore decides on 14 January 2010 to impose a lifetime period of ineligibility on the Athlete, starting on the date of the decision.

In September 2009 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Angelo Ionel Alexa after his sample tested positive for the prohibited substance testosterone with a T/E ratio above the WADA threshold.
After notification the Athlete failed to attend the hearing of the Commission.
Therefore the ANAD Hearing Commission decides on 14 January 2010 to impose a 2 year period of ineligibility on the Athlete, starting on the date of the decision.

ANAD Comisia de Audiere 2010_06 ANAD vs Ioan Rareș Şuteu

In December 2009 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Ioan Rareș Şuteu after his sample tested positive for the prohibited substance canrenone and stanozolol.
After notification the Athlete filed a statement in his defence and did not request the B sample analysis.

The ANAD Hearing Commission decides on 14 January 2010 to impose a 2 year period of ineligibility on the Athlete, starting on the date of the decision.
