UKAD 2014 BWLA vs Vasyl Kruk

Facts
The British Weightlifting Association charged Vasyl Kruk, the "Athlete", for a violation of the Anti-Doping rules. On February 24, 2014, the Athlete provided an out-of-competition sample for doping control purposes. The analysis of the sample showed the presence of the metabolites of drostanolone, nandrolone and metandienone which are prohibited substances according the World Anti-Doping Agency (WADA) prohibited list.

History
A most important feature of this case is that the Athlete has previously been found guilty of an Anti-Doping Rule Violation (“the First ADRV”) for which the Athlete received a two year period of Ineligibility beginning on May 26, 2012 and ending at midnight on 25 May 2014. He didn't attend the hearing and confirmed the use of steroids in period between Feb 2014 and May 2014 during his ban period. The genuine reason for it was not to cheat on competition but only bring fitness back. In this response the Athlete was alluding to his lack of fitness arising out of the period of Ineligibility imposed on the Athlete as a result of the First ADRV. It contains a frank admission that he was taking steroids during the period of Ineligibility.

Decision
The sanction is a period of Ineligibility of eight years commencing from 9 am (BST) 25 May 2014 and ending at 9 am (BST) 25 May 2022.

Costs
Each party will bear their own costs of these proceedings.

Appeal
No later than 21 days from the date of receipt of this decision.

NADDP 2013 National Anti-Doping Commission of Malta vs Simon Aquilina

In December 2013 the National Anti-Doping Commission of Malta has reported an anti-doping rule violation against the Athlete Simon Aquilina after his A and B samples tested positive for the prohibited substance cocaine. After notification a provisional suspension was ordered. The Athlete filed a statement in his defence and was heard for the National Anti-Doping Disciplinary Panel of Malta.

The Athlete argued that there were departures from the International Standard for Testing (IST) due to the Athlete’s samples were not handled in a manner that protected its integrity, identity and security prior to transport from the Doping Control Station.
The National Anti-Doping Disciplinary Panel dismissed the Athlete’s arguments and decides on 13 March 2014 to impose a 2 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 10 December 2013.

"Doping in Germany from 1950 to today from a historical and sociological perspective in the context of ethical legitimacy" sponsored research funds from the Federal Institute of Sport Science upon a decision of the German Bundestag.

The aim of the research project is to describe the complexity of the issue of doping, its requirements, conditions and effects in the period between 1950 and 2007, the focus of the study lies in the following areas: The "Stations of doping in Germany" and their "ethical and legal reflection" and the "reception of doping in Germany in the media" and "doping in the relationship between state and Sport".

The division of areas of work and the associated different methodological approach ensures a comprehensive explanation of a partially in the dark field moving phenomenon and its individual cases and sets this in a socio-historical context. The respective historical contexts of meaning are to be reconstructed and allow an assessment of individual cases and system effects in the particular context of the time and from today's perspective.

For systematizing and structuring the data, meaningful temporal phases were identified.

The research groups of interdisciplinary and transdisciplinary approach the subject matter here with a methodological mix of a systematic analysis of all relevant documents from archives, a big quantitative content analysis with a "denser" qualitative content analysis as well as through surveys of selected witnesses in adapted interviews. The latter are carried out according to the proven, differentiated methodological rules of "oral history". The results are brought together in a respective contemporary construct.

On 17 October 2007 the Sanction Committee of the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, decided to impose a 2 year period of ineligibility on the Athlete Mihaela Botezan after her A and B samples tested positive for the prohibited substance chlorthalidone.

The Athlete stated that she used the substance without intention to enhance her sport performance.

The ANAD Appeal Commission considers the Athlete’s arguments and decides on 25 January 2008 to dismiss the appeal and to uphold the Sanction Committee’s decision of 17 October 2007.

On 3 July 2007 the ANAD Sanction Committee decided to impose a 4 year period of ineligibility on the Coach Ion Iordache as accomplice to two Athletes whom refused to provide a sample for drug testing after notification.

Hereafter the Coach appealed the decision of the ANAD Sanction Committee of 3 July 2007 with the ANAD Appeal Commission.
The Appeal Commission considered the evidence and concludes that the reports filed by the Doping Control Officers showed no evidence of the Coach’s guilt in relation the violations committed by the two Athletes. Also the statement of the two Athletes showed no involvement of the Coach.

Therefore on 29 August 2007 the ANAD Appeal Commission decides to set aside the decision to the ANAD Sanction Committee an to acquit the Coach.

In November 2007 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Sorin Marza after his sample tested positive for the prohibited substances epimetendiol (metandienone). The Athlete admitted the use of Naposim.

Therefore on 1 November 2007 the ANAD Sanction Committee decides to impose a 2 year period of ineligibility on the Athlete starting on the date of the decision.

Therefore on 17 October 2007 the ANAD Sanction Committee decides to impose a 2 year period of ineligibility on the Athlete starting on the date of the decision.

In September 2007 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Mihai Gabriel Feroiu after his sample tested positive for the prohibited substances furosemide and 3'-hydroxystanazolol (stanozolol).

Therefore on 17 October 2007 the ANAD Sanction Committee decides to impose a 2 year period of ineligibility on the Athlete starting on the date of the decision.
