Mr. Jack Robertson is Chief Investigative Officer of the World Anti-Doping Agency (WADA).
He testified to USADA that WADA was admitted as a party in the Italian Carabinieri NAS investigative proceedings and has been given access to the file in order to review and obtain documents and information related to Dr. Michele Ferrari, including his clients and relatives, and others involved in potential violations of sport anti-doping rules.

The French Federation of Billiards (Fédération Française de Billard, FFB) charges respondent M15 for a violation of the Anti-Doping Rules. During a contest on July 5, 2009, a sample for a doping test was taken. The sample tested positive for atenolol. Atenolol is a prohibited substance according the World Anti-Doping Agency (WADA) prohibited list.

History
The respondent used medication to treat high blood pressure and overweight. There was no intention to enhance sport performance.

Decision
1. The decision (a warning) dated October 10, 2010, of the disciplinary committee of the FFB should be modified.
2. The sanction is a period of ineligibility of one month in which the restpondent can take part in competition or manifestations organized by the FFB.
3. The decision starts on the date of notification.
4. The decision will be published and sent to the parties involved.

Ms Dawn Polay testified to USADA about the conversations she had with her close friend Betsy Andreu who also testified to USADA.
Ms Polay stated that Betsy was upset after her visit with Mr. Andreu to Lance Armstrong in the Indiana University Hospital on 27 October 1996 where Armstrong was for a cancer treatment. In a full room she heard Lance Armstrong confessing to his doctors that he had used performance enhancing drugs. Also Betsy Andreu shared her concern with Ms Polay about the use of doping by Mr. Andreu as professional cyclist.

Ms. Emma O’Reilly is a soigneur in the U.S. Postal Service Cycling Team during the cycling seasons from 1996 through 2000.
Ms. O’Reilly testified to USADA about the widespread trafficking, distribution, possession, administration and use of prohibited substances and methods in the professional cycling team, her involvement and the involvement of Lance Armstrong, accompliced riders, medical doctors and officials.
Ms. O’Reilly resigned from the U.S. Postal Service Cycling Team after the 2000 season and has not worked in cycling since that time.

Facts
The French Shooting Federation (Fédération Française de Tir, FFTir) charges respondent M14 for a violation of the Anti-Doping Rules. During a shooting contest , on May 9, 2009, a sample for doping test purposes was taken. The sample tested positive on a metabolite of cannabis which is a prohibited substance on the World Anti-Doping Agency (WADA) prohibited list. Cannabis is regarded as a specified substances.

History
The respondent used the prohibited substance a month before the doping test in a recreational setting. There was no intention to enhance sport performance.

Decision
1. The sanction is a period of ineligibility of two months.
2. The result of the constest of May 9, 2009, will be cancelled. Medals, points and prizes are withdrawn.
3. The decision starts on the date of notification.
4. The decision will be published and sent to the parties involved.

Mr. Renzo Ferrante is a member of the Italian Carabinieri NAS law enforcement agency. Mr. Ferrante stated to USADA that in the course of their investigation of Dr. Ferrari they have obtained bank records relating to payments made by athletes and others to Dr. Ferrari and his son Stefano Ferrari. Also they have obtained electronic mails between athletes and athletes support personnel, including Lance Armstrong, Johan Bruyneel and others to Dr. Ferrari and to entities controlled by Dr. Ferrari and his son Stefano Ferrari.
In addition they have obtained evidence and witness statements provided by professional cyclist against Dr. Ferrari.

The World Anti-Doping Agency (WADA) has been admitted by the Italian prosecutor and has been given access to the casefile in order to review and obtain documents and information related to Dr. Ferrari, including his clients and relatives, and others involved in potential violation of sport antidoping rules.

The French Federation for Savate, French Boxing and Associated Disciplines (Fédération Française de Savate Boxe Française et Disciplines Associées, FFSBFDA) charges respondent M13 for a violation of the Anti-Doping Rules. During an event on May 16, 2009, a sample was taken for doping test purposes. The analysis of the sample showed the presence a metabolite of cannabis. Cannabis is a prohibited substance according the World Anti-Doping Agency (WADA) prohibited list, it is regarded as a specified substance.

History
The respondent used cannabis a week before the doping test in a recreational setting.

Decision
1. The decision, dated October 20, 2009, of the disciplinary committee of the FFSBFDA should be modified.
2. The sanction is a period of ineligibility of six months, in which respondent can't take part in competition or manifestations organized by the FFSBFDA.
3. The decision starts on the date of notification.

The French Cycling Federation (Fédération Française de Cyclisme, FFC) charges respondent M12 for a violation of the Anti-Doping Rules. During a cycling event on August 27, 2009, a sample was taken for doping test purposes. The analysis of the sample showed the presence of budesonide which is a prohibited substances according the World Anti-Doping Agency (WADA) prohibited list. This substances is regarded as a specified substances.

History
Respondent inhales a pharmaceutical which contains the prohibited substance to treat asthma. He also has reports to prove his condition.

Decision
1. The respondent is acquitted.

Mr. Marco Consonni is an Italian lawyer who provided legal assistance in Italy to the World Antidoping Agency (WADA) in relation to the investigative proceedings by the office of the Public Prosecutor of Padua, Italy. The proceedings relates to Mr Michele Ferrari, an Italian doctor, and other people, including Dr Ferrari's clients and relatives involved in potential violation of anti-doping rules.

Mr. Consonni stated that working on this case, he found evidence of a previous criminal proceedings related to potential violations of anti-doping rules committed by Dr. Ferrari and other people in Italy in the period from 1995 to 1998. These proceedings included doping treatments to Mr Filippo Simeoni, an Italian professional cyclist, in the period 1995 - 1997 by Dr Ferrari. Mr Simeoni was a witness in this case. The proceedings resulted in a decision of the Criminal Tribunal of Bologna dated 1 October 2004 which condemned Dr Ferrari for sporting fraud and abuse of the medical profession while he was acquitted of other crimes' indictments, mainly for statue of limitation.

The decision was appealed before the Court of Appeal of Bologna and then before the Italian Supreme Court ("Corte di Cassazione"). With its above mentioned decision, the Italian Supreme Court analyses the previous decisions of the case made by the Tribunal and by the Court of Appeal of Bologna and states that, while the statute of limitation operates in relation to the indictments contested to Dr Ferrari, there were clear "objective" evidences of Dr Ferrari liability for sporting fraud and violation of anti-doping rules with specific reference of prescription of doping medications to athletes.

Mr. Larry D. Bowers, PhD Chief Science Officer, US Anti-Doping Agency provides an expert opinion as to whether the absence of a "failed" doping control test is proof that the athlete did not dope.

Mr. Bowers stated that when several factors are considered, it is not possible to equate a "negative test" with the absence of doping at the current time. Mr. Bowers: “It would be relatively easy to avoid detection for doping if the anti-doping program is not as rigorous as it should be. Even with a well-executed collection and testing system, however, it is possible to use some products in specific routes of administration that would be very difficult to detect. In addition, there are some prohibited substances and methods for which there is no effective test (e.g., autologous blood transfusion and until very recently GH). The unfortunate result of this situation is, as illustrated by contemporary examples such as Marion Jones, David Millar, and many others, athletes who have claimed never to have failed a drug test have later admitted their use of performance enhancing drugs.”
