NBB 2008 NBB Decision Disciplinary Committee 2008019 T

The Netherlands Basketball Federation (Nederlandse Basketball Bond, NBB) reported a violation of the Anti-Doping Code. The defendant was tested positive for the prohibited substance Carboxy-THC which is a metabolite for tetrahydrocannabinol.
At the oral hearing defendant explains he had been eating so called space cake at a party, he didn't report this before or during the doping test.
The decision is a period of ineligibility, shortened with his period of voluntary suspension, from September 10, 2008 till November 1, 2008.
An appeal can be made within 7 days.

Facts
The Royal Dutch Billiards Federation (Koninklijke Nederlandse Biljartbond, KNBB) reported a violation of the Anti-Doping Code. During a competition match the defendant was tested, his A-sample was found positive for the prohibited substance metoprolol.
The oral hearing took place on February 25, 2008, the defendant was present, and he presented his medical record.

History
He did ask for dispensation due to his history of a heart disease, at first this form was sent to the wrong address but later he sent the form correctly.
The defendant did enter the names of the medicine on the form handed out during the doping test.
A small error was made in handling the paper work, the wrong laboratory was mentioned but this was corrected and regarded as insignificant.
The defendant wasn't aware that his medication could have a prohibited substance; the KNBB never provided sufficient information about this. The KNBB claims information is also available on their website.

In his considerations the disciplinary committee takes into account that the defendant did not arranged his dispensation for medical uses correctly, but his heart condition and medicine use are a fact.

Decision
The decision of the Disciplinary Committee, realizing it's a first offence, is a warning and reprimand, no period of ineligibility. Legal cost and fees only partly have to be borne by the defendant.

The Royal Dutch Billiards Union (Koninklijke Nederlandse Biljart Bond KNBB) has reported an anti doping rule violation against this person after he tested positive for the prohibited substance benzoylecgonine (a metabolite of cocaine).
Person filed several statements and objections in his defence. Person made futile objections about the provisional suspension and the credibility regarding the anti-doping test, the KNBB, the Disciplinary Committee and the Anti-doping Authority (DA).

In this Decision, dated March 21, 2011, the Disciplinary Committee rules a written proceeding of person’s filed statements and objections. The Committee decides to continue person’s provisional suspension. Fees and expenses for this committee shall be borne by person.

The Royal Dutch Motorcyclists Association (Koninklijke Nederlandse Motorrijders Vereniging, KNMV) has reported an anti doping rule violation against this person after his sample tested positive for the prohibited substance formoterol. Person declined a hearing for the committee but filed a statement in his defence.
Person had medical dispensation for a drug, containing the prohibited ingredient formoterol. When tested person reported the DCO the use of a medical drug and his dispensation. At the time of the anti-doping test person’s 2007 dispensation was expired, but a new dispensation was already applied and approved April 15, 2010.
Considering exceptional circumstances, the Disciplinary Committee decides to reprimand person. Fees and expenses shall be borne by person.

The Royal Dutch Motorcyclists Association (Koninklijke Nederlandse Motorrijders Vereniging, KNMV) has reported an anti doping rule violation against the Person after his A and B samples tested positive for the prohibited substance cannabis. After notification the Person filed a statement in his defence and he was heard for the KNMV Disciplinary Committee.

The Person denied that he had smoked cannabis and stated that he had stayed a long period with people smoking cannabis in a small unventilated environment. The Person argued that due to this passive smoking the cannabis came into his system and that the violation was not intentional.
Considering exceptional circumstances, the KNMV Disciplinary Committee decides on 15 September 2010 to impose a reprimand on the Person.

Fees and expenses shall be borne by the Person.

KNBSB 2010 KNBSB Decision Appeal Committee 2010041 B

On July 8, 2010, the Royal Dutch Baseball and Softball Federation (Koninklijke Nederlandse Baseball en Softball Bond, KNBSB) Disciplinary Committee decided to impose a 2 year period of ineligibility on the person after his sample tested positive for the prohibited substance methylhexaneamine (dimethylpentylamine)

Person stated in his defence that he had used a supplement with the prohibited ingredient geranamine (methylhexaneamine), but didn’t know it was since 2009 on the prohibited list.
In September 2010 WADA published the 2011 prohibited list. The status of 4-methyl-2-hexanamine (methylhexaneamine) changed to ‘specified substance’. This status change was made after request of a number of anti-doping authorities, including the Dutch Anti Doping Authority, because free available supplements contain this substance.
This status change gives the committee the possibility to reduce the sanction due to the lex mitior. On 12 October 2010 the committee already lifted person’s ineligibility and on 8 February 2011 the KNBSB Appeal Committee decides to reduce the period of ineligibility until 12 October 2011. Fees and expenses for this Appeal Committee shall be borne by sport club.

The Person admitted he had used cocaine at a party a few days prior to the doping control without intention to enhance his performance. Without mitigating circumstances the Disciplinary Committee decides on 15 September 2010 to impose a two year period of ineligibility starting on the date of the provisional suspension. Fees and expenses for this committee shall be borne by person.

The Royal Netherlands Power Sport and Fitness Federation
(Koninklijke Nederlandse Krachtsport en Fitnessfederatie, KNKF)
reports defendant for not attending an out of competition doping test. The defendant filed a written defence on November 17, 2007. The defendant didn't attend the oral hearing on December 17, 2007.
In writing the defendant claims he is not a member anymore of the KNKF. The Committee agrees because he ended his membership in time.
The defendant is free of charge, all the expenses are for the KNKF.

ISR 2010 NHB Decision Disciplinary Committee 2010051 T

The Dutch Archery Association (Nederlandse Handboog Bond, NHB) has reported an anti doping rule violation against this person after he tested positive for the prohibited substance
11-nor-∆9-tetrahydrocannabinol-9carboxylic acid (a metabolite of cannabis).
NHB notified the person of the doping violation and ordered a provisional suspension. Person filed a statement in his defence and was heard for the Committee. Person stated he had smoked a joint one week prior to the anti-doping test because of stress and had no intention to enhance his performance. His statement was supported by witnesses.
The committee accepts person’s statement and, with exceptional circumstances, decides to reprimand person with ineligibility for the provisional suspension.

ISR 2010 KNWU Decision Disciplinary Committee 2010074 T

The Royal Dutch Cycling Federation (Koninklijke Nederlandse Wielren Unie, KNWU) has reported an anti doping rule violation against this person after he tested positive for the prohibited substance clenbuterol in the A and B samples.
Person was tested before without problems and the concentration clenbuterol in the samples was very low.

Person was heard for the committee and stated the positive test results were caused by clenbuterol contaminations in meat during his stay in Mexico prior to the anti-doping control. His statement was supported by literature about the illegal use of clenbuterol in the Mexican food industry. Person’s travel report showed he had been cautious with food during his stay in Mexico to avoid contaminations.

The Disciplinary Committee considered person’s statement acceptable and decided to acquit person of violation the Anti-Doping Rules without sanction. KNKF should bear half de cost, made for person’s defence.
