ADDPI 2023_132 INADA vs Khushi

In May 2023 the India National Anti-Doping Agency (INADA) reported an anti-doping rule violation against the powerlifter Khushi after her sample tested positive for the prohibited substances Clenbuterol, Mephentermine and Methasterone.

Following notification a provisional suspension was ordered and she was heard for the Anti-Doping Disciplinary Panel of India (ADDPI).

The Panel finds that the presence of prohibited substances has been established in the Athlete's sample and accordingly that she committed an anti-doping rule violation.

Therefore the Panel decides on 16 October 2023 to impose a 4 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 8 May 2023.

World Athletics 2021 WA vs Titus Ekiru

In June 2021 and February 2022 the Athletics Integrity Unit (AIU) reported two separate anti-doping rule violations against the Kenyan Athlete Titus Ekiru for the presence of prohibited substances.

The Athlete's Sample 1, provided in May 2021 in Italy, tested positive for the prohibited substance Triamcinolone acetonide. Thereupon his Sample 2, provided in November 2021 in the United Arab Emirates, tested positive for the substance Pethidine.

Regarding Sample 1 the Athlete explained in June 2021 with medical documents that he underwent medical treatment for his injury in a hospital in Kenya. His doctor corroborated in a written statement in November 2021 that Triamcinolone acetonide had been injected.

In the matter of Sample 2 the Athlete explained in February 2022 with medical documents that he had used prescribed medication for his injury. However this time the AIU established that these medical documents were falsifications.

Consequently the AIU revisited its findings regarding Sample 1 and reported in February 2022 an new anti-doping rule violation against the Athlete for tampering.

In both cases the AIU had requested assistance from the Anti-Doping Agency of Kenya (ADAK) with an investigation into the Athlete's explanations and supporting medical documents.

ADAK's investigations revealed that in both cases the Athlete had provided false statements and forged/fraudulent documents. Moreover the first hospital in question had no Triamcinolone acetonide in stock and in the second hospital no Pethidine had been dispensed at the material time.

Eventually in July 2023 the Athlete was charged for the presence of prohibited substances in both samples. Also the Athlete was charged for tampering by obstructing or delaying an AIU investigation and for providing false/misleading information and documentation regarding Sample 1 and Sample 2.

At first the Athlete contested the charges, however in September 2023 he requested termination of the disciplinary proceedings before the Disciplinary Tribunal. Thereupon the AIU deems that the Athlete has admitted the violations, waived his right for a hearing and accepted the consequences.

In the case of Sample 1 the AIU considers that the presence and tampering violation shall be treated together as one single violation for the imposition of sanction of 4 years. Because of aggravating circumstances in this case the period of ineligibility is increased to a total of 6 years.

The tampering violation regarding Sample 2 is considered a stand-alone-first violation and the 4 year period of ineligibility shall be served consequtively to the period imposed for the underlying violation.

Therefore the AIU decides on 16 October 2023 to impose a total of 10 years on the Athlete, starting on the date of the provisional suspension, i.e. on 28 June 2022.

ADDPI 2023_126 INADA vs Bajrang

In April 2023 the India National Anti-Doping Agency (INADA) reported an anti-doping rule violation against the powerlifter Bajrang after his sample tested positive for the prohibited substances Letrozole, Mephentermine, Phentermine, Stanozolol and Trenbolone.

Following notification a provisional suspension was ordered. The Athlete filed a statement in his defence and he was heard for the Anti-Doping Disciplinary Panel of India (ADDPI).

The Athlete admitted the violation and stated that he had received injections in order to improve his performances. He asserted that he was unaware that these substances were prohibited.

The Panel finds that the presence of prohibited substances has been established in the Athlete's sample and accordingly that he committed an anti-doping rule violation.

Therefore the Panel decides on 12 October 2023 to impose a 4 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 12 April 2023.

ADDPI 2023_122 INADA vs Mumin Khan

In May 2023 the India National Anti-Doping Agency (INADA) reported an anti-doping rule violation against the powerlifter Mumin Khan after his sample tested positive for the prohibited substances Fluoxymesterone, Torasemide and Trenbolone.

Following notification a provisional suspension was ordered. The Athlete filed a statement in his defence and he was heard for the Anti-Doping Disciplinary Panel of India (ADDPI).

The Panel finds that the presence of prohibited substances has been established in the Athlete's sample and accordingly that he committed an anti-doping rule violation.

The Panel determines that the Athlete had acted negligently as he had used supplements without consultation of a doctor, his coach or any other expert.

Therefore the Panel decides on 12 October 2023 to impose a 4 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 10 May 2023.

ADAK 2023 ADAK vs Agnes Mumbua

In May 2023 the Anti-Doping Agency of Kenya (ADAK) reported an anti-doping rule violation against the Athlete Agnes Mumbua after her sample tested positive for the prohibited substance Methasterone.

Following notification a provisional suspension was ordered. The Athlete filed a statement in her defence and she was heard for the Kenya Sports Disputes Tribunal.

The Athlete denied the intentional use of the substance and requested the Panel for a reduced sanction. She explained that she underwent medical treatment for her condition whereas she had used medication and received injections.

The Panel finds that the presence of a prohibited substance has been established in the Athlete's sample and accordingly that she committed an anti-doping rule violation.

The Panel determines that the Athlete failed to demonstrate with any corroborating evidence that she underwent medical treatment for her alleged condition, neither that the violation was not intentional. Further the Panel considers that there had been substantial delays in the proceedings not attributed to the Athlete.

Therefore the Panel decides on 12 October 2023 to impose a 4 year period of ineligibility on the Athlete, starting on the date of the sample collection, i.e. on 27 February 2022.

CAS 2023_ADD_60 IWF vs Dmitry Chalyy

2023/ADD/60 International Weightlifting Federation (IWF) v. Mr. Dmitry Chalyy

In 2016, Professor Richard McLaren issued two reports about systemic doping in Russia. These reports identified a significant number of Russian athletes who were involved in, or benefitted from, the doping schemes and practices that he uncovered.

Hereafter in January 2019 the World Anti-Doping Agency (WADA) recovered the internal database of the Moscow Laboratory (LIMS). Following investigation of allegations of organized doping practices, and in particular of the LIMS, WADA provided international federations with investigation reports on the athletes implicated in these organized doping practices.

As a result in September 2022 the International Testing Agency (ITA), on behalf of the International Weightlifting Federation (IWF), reported an anti-doping rule violation against the Athlete Dmitry Chalyy for the use of the prohibited substances Drostanolone and Oxandrolone in September 2012.

Following notification a provisional suspension was ordered. Thereupon in May 2023 the case was referred to the CAS Anti-Doping Division (CAS ADD) for a Sole Arbitrator first instance procedure.

In this case the Athlete failed to admit the violations, nor accepted the consequences, nor provided any evidence or submissions.

The Sole Arbitrator assessed the evidence in this case and concludes that:

  • The Athlete had committed an anti-doping rule violation;
  • There are aggravating circumstances present in this case;
  • The fairness exception is applicable regarding disqualification of results; and
  • The period of disqualification shall be from 22 September 2012 until 21 September 2016.

Therefore Court of Arbitration for Sport decides on 5 October 2023 that:

1.) The request for arbitration filed by the International Weightlifting Federation on 10 May 2023 is partially upheld.

2.) Mr. Dmitriy Chalyy is found to have committed an anti-doping rule violation under Article 2.2 of the 2012 IWF Anti-Doping Policy.

3.) Mr. Dmitriy Chalyy is sanctioned with a period of ineligibility of four (4) years starting on the date of this Award. Any period of provisional suspension effectively served by Mr Dmitry Chalyy before the date of this Award shall be credited against the total period of ineligibility to be served.

4.) All competitive results obtained by Mr. Dmitriy Chalyy from and including 22 September 2012 until 21 September 2016 be disqualified, with all resulting consequences (including forfeiture of medals, points and prizes).

7.) All other motions or prayers for relief are dismissed.
