In July 2012 the Royal Netherlands Power Sport and Fitness Federation (KNKF) has reported an anti-doping rule violation after the Athlete refused to provide a sample for drug testing.
After notification the Athlete filed a statement in his defence and was heard for the Disciplinary Committee.
The Athlete stated that after he was notified by the DCO to provide a sample he had doubts about the validity of the doping control and referred the DCO to his coach to decide. The coach decided that the Athlete should not cooperate with the doping control and signed the Doping Control Form instead of the Athlete.
The DCO failed to let the Athlete sign the Doping Control Form and did not ask the Athlete’s coach for his identification when he signed the Doping Control Form.
The Disciplinary Committee considered that this is the Athlete’s second violation and therefore he should know the consequences of his refusal and disregarding his liability.
Therefore the Disciplinary Committee decides to impose a 6 year period of ineligibility on the Athlete, starting on the date of the decision, i.e. on 29 November 2012.
Fees and expenses for this committee shall be borne by the Athlete.
