AFLD 2009 FFSquash vs Respondent M07

Facts
The French Squash Federation (Fédération Française de Squash, FFSquash) charges respondent M07 for a violation of the Anti-Doping Rules. During a squash event on July 27, 2008, a sample for doping test purposes was taken. The sample tested positive for a metabolite of cannabis. Cannabis is a prohibited substances according the World Anti-Doping Agency (WADA) prohibited list. It is regarded as a specified substances.

History
The respondent had used cannabis two days before the doping control. He used it in a recreational setting, there was no intention to enhance sport performance. However the respondent had received an earlier sanction which was a period of ineligibility of six months.

1 The sanction is a period of ineligibility of two years in which respondent can't take part in competition or manifestation organized by French sport federations.
