In 2006 the professional cyclist X and his personal mentor Y were mentioned in a Spanish doping scandal for having close contact with 4 Spanish doctors involved in doping practices.
As consequence the Athlete’s sponsors cancelled their contracts with X, due to breach of the anti-doping stipulations in the sponsor contract.
X signed these contracts with his sponsors in 2004 and 2005 and therefore agreed with the anti-doping stipulation in these contracts while already involved in doping since 2003.
The German Public Prosecutor in Bonn opened investigations against X, for suspicion of fraud and violation of the German medication legislation. Also against Y who alleged purchased and administered the prohibited substances for X.
Therefore the German Public Prosecutor in Bonn filed a number or requests for international legal assistance with the Swiss Federal Court in Thurgau in order to collect evidence in Switzerland against X and Y in their houses.
X filed complaints against the investigations in Switzerland which the Thurgau Cantonal Court dismissed on 16 May 2007.
Hereafter on 17 July 2007 the Swiss Federal Court dismissed the appeal of X against the decision of the Thurgau Cantonal Court.
