In May 2010 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported a anti-doping rule violation against the Athlete Corina Dumbrӑvean after she attempted to tamper with her sample and refused to provide a sample for drug testing.
Considering this is the Athlete’s second violation the ANAD Hearing Commission decided on 8 July 2010 to impose a lifetime period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 3 June 2010 (case 18/08.07.2010).
As a result of the Dumbrӑvean case the ANAD Hearing commission decided on 24 August 2010 to imposed a 4 year period of ineligibility on the Athlete’s sport manager Mr. Eleodor Rosca for assisting, instigating or showing any other form of complicity to the Athlete’s anti-doping rule violation (case 30/24.08.2010).
In October 2010 Mr. Rosca appealed the ANAD decision (case 30/24.08.2010) with the ANAD Appeal Commission.
The Commission reviewed Mr. Rosca’s case and finds that his violation is not stipulated explicitly and without reference to the violations mentioned in the anti-doping rules.
The Commission also concluded that Mr. Rosca was not present at the doping control station where the Athlete Corina Dumbrӑvean was tested. Also there is no evidence that he adviced the Athlete to refuse the provision of a sample or that he assisted her to violate the anti-doping rules. In addition showe the statements of the two DCO’s that Mr. Rosca collaborated with them to make to sample collection possible with the selected Athlete’s.
Therefore the ANAD Appeal Commission rules on 18 November 2010 the Mr. Eleodor Rosca’s appeal is admissible and decides to annul the decision of the ANAD Hearing Commission (case 30/24.08.2010).
