Facts
The National Anti-Doping Agency of Romania (Agenţia Naţională Anti-Doping, ANAD) charges Simona Paula Maxim, the athlete, for a violation of the Anti-Doping rules. During an out-of-competition doping control on August 1 and August 3, 2013, the athlete was not present for a scheduled doping control. She finally provided a sample for doping test purposes on August 5, 2013. Analysis of this sample showed the presence of recombinant human erythropoietin (rhEPO).
History
The athlete claims at the hearing that she had left the training camp due to family problems, she had communicated with the president of Romanian Athletics Federation about the nature of the problems. Because she was in a rural area she was unable to communicate by her cellular, there was no signal from her provider Orange. Also she claims not to have been informed that she had to be present for a doping control. She finally provided a sample for doping test purposes on August 5, 2013.
However it was made clear that she had been informed that she belonged to the designated testing group, with all the obligations. Her coach contradicted that she had no access to Orange signal and she was not able to call.
Her positive test is considered as a second violation.
Decision
- The sanction is a period of ineligibility of 4 years.
- The period of ineligibility starts from the date of the decision August 28, 2013, till August 7, 2017.
