Facts
The National Anti-Doping Agency of Romania (Agenţia Naţională Anti-Doping, ANAD) charges Andre Gaita, the athlete, for a violation of the Anti-Doping rules. During an in-competition doping control on May 17, 2014, the athlete provided a sample for doping test purposes. Analysis of this sample indicated a testosterone / epitestosterone ratio higher than 4. An additional Isotope-ratio mass spectrometry (IRMS) test revealed the exogenous origin of testosterone. Testosterone is a prohibited substance according the World Anti-Doping Agency (WADA) 2014 prohibited list.
History
The athlete claims the positive test derived from a product containing testosterone for postoperative recovery and this was also declared in the Doping Control Form.
During the hearing the athlete provided his discharge summary of the hospital, as well as the medical prescription signed by the physician for .
The athlete had not taken part in matches for a long time.
The commission agreed for a reduction of the sanction.
Decision
- The sanction is a period of ineligibility of 1 year and 6 months.
- The period of ineligibility starts from the date of the sample collection, May 17, 2014, till November 16, 2015.
- The athlete still has to provide his whereabouts data for no advance doping controls.
