Facts
Elena Madalina Capraru, the appellant, appeals against the decision no. 16, dated October 28, 2014, of the "Hearing Commission for
the athletes and their support personnel who violated the anti-doping rules". The appellant had been sanctioned with a period of ineligibity of two years for the adverse analytic finding of metandienone.
The representative of the of the appellant wants to have a retrial by the hearing commission. A lesser sanction should apply because the appellant had been unaware of the use of a prohibited substance.
History
The prohibited substance had been administered to her by her tennis coach who she trusted. Although an athlete is responsible for her ingestion the athlete had proved how the ingestion took place which was confirmed by her coach. For this a reduction is applicable.
Decision
- The sanction is a period of ineligibility of one year in which the athlete can not take part in Bodybuilding and Tennis events.
- The period of ineligibility starts from the date of the decision October 28, 2014, till October 27, 2015.
