In January 2015 the Japan Anti-Doping Agency (JADA) has reported an anti-doping rule violation against the Athlete J-4070 (the Athlete) after her sample tested positive for the prohibited substance tulobuterol. After notification a provisional suspension was ordered and the Athlete filed a statement in her defence.
The Athlete submitted, sustained by her doctor and medical record, that she suffered from asthma bronchitis and cough and had used prescribed Hokunalin medication as treatment without intention to enhance her sport performance.
The Panel concludes that the Athlete was negligent due to she failed to check the ingredients of the medication before using and also finds that the Athlete’s doctor had insufficient knowledge about anti-doping rules and prohibited substances in Volleyball.
Considering the circumstances in this case the Japan Anti-Doping Disciplinary Panel decides on 18 February 2015 to impose a 2 month period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. on 7 January 2015.
