NADO Flanders 2015 Disciplinary Council 2015031 B - Appeal
January 22, 2016
On 27 October 2015 the NADO Flanders Disciplinary Commission decided to impose a 4 year period of ineligibility on the minor Dutch cyclist after his A and B samples tested positive for the prohibited substances amphetamine, 19-norandrosterone and 19-noretiocholanolone (nandrolone).
The Athlete appealed his case with the NADO Flanders Disciplinary Council. At the hearing he admitted the violation and stated that in November and December 2014 his father as his coach administered him injections with the prohibited substance and gave him supplements.
The Council accepted the Athlete’s explanation how the prohibited substances entered his body and considered that he acted with no significant fault or negligence because at the time of the violation he was trusting as a minor his father as his coach.
With grounds to reduce the imposed sanction the NADA Flanders Disciplinary Council decided on 22 January 2016 to impose a 2 year period of ineligibility on the Athlete.
As a consequence of this case the Royal Dutch Cycling Federation (KNWU) reported an anti-doping rule violation against the Athlete’s father (as his coach) for the administration of the prohibited substances 19-norandrosterone and 19-noretiocholanolone (nandrolone) to his minor son.
After notification the father waived his right to be heard and submitted a statement in which he admitted the violation and accepted the sanction of the ISR-KNWU Disciplinary Committee.
Considering aggravating circumstances for the administration of prohibited substances by athlete support personnel to a minor the ISR-KNWU Disciplinary Committee decides on 26 September 2016 to impose a lifetime ban. Fees and expenses for this committee shall be borne by the person.
