In June 2017 the India National Anti-Doping Agency (INADA) has reported an anti-doping rule violation against the Athlete Davinder Singh Kang after his sample tested positive for the prohibited substance Cannabis in a concentration above the WADA threshold. After notification a provisional suspension was ordered. The Athlete filed a statement in his defence and he was heard for the Anti-Doping Disciplinary Panel of India (ADDPI).
The Athlete admitted the violation and denied the intentional use. He explained that at that time he suffered from nose bleedings and urination problems and as treatment he had used a local prepared product Thandai. After the positive test the Athlete became aware that the Thandai contained Bhang (Cannabis) as ingredient.
INADA contended that the Athlete failed to check the ingredients of the product before using and that the Athlete previously also had tested positive for steroids in February 2018.
The Panel accepts the Athlete’s explanation and finds that the substance was used a context unrelated to sport performance. The Panel deems that the Athlete gave a prompt admission, that he established grounds for No Significant Fault or Negligence and that there were delays in the proceedings not attributed to the Athlete.
Therefore the ADDPI decides on 23 April 2018 to impose a reprimand on the Athlete.
