In March 2018 the United States Anti-Doping Agency (USADA) has reported an anti-doping rule violation against the archer Bob Eyler after his A and B samples tested positive for the prohibited substances Propranolol and Cannabis in a concentation above the WADA threshold. After notification the Athlete did not accept a provisional suspension.
The Athlete accepted the test results and admitted the use of prescribed Propranol as treatment for his migraine while he mentioned his medication on the Doping Control Form. Afterwards the Athlete’s TUE application for his medication was granted by USADA in June 2018. His application for a retroactive TUE was denied by World Archery in August 2018.
The Panel finds that the Athlete’s explanation about his decision to participate in the event and about the Cannabis was confusing and contradictory. The Panel deems that the Athlete established how the Propranol entered his system. However his explanations about the Cannabis are inconsistent, contradictory and evasive regarding the source, manner, timing and location of ingestion. Further the Athlete failed to establish No Significant Fault or Negligence in this case.
Without grounds for a reduced sanction the North American Court of Arbitration for Sport Panel decides on 28 September 2018 to impose a 2 year period of ineligibility on the Athlete starting on the date of the decision. Consequently all the Athlete’s competitive results from 11 February 2018 through the date of the decision are disqualified.
