In July 2017 the Anti-Doping Agency of Kenya (ADAK) has reported an anti-doping rule violation against the Athlete Edwin Kipyego after his sample tested positive for the prohibited substance Erythropoietin (EPO). After notification a provisional suspension was ordered and the Athlete filed a statement in his defence.
The Athlete admitted the violation, denied intentional use, provided substantial assistance to ADAK and waived his right to be heard for the Judiciary Office of the Kenya Sports Disputes Tribunal. He testified that at a clinic, recommended by his friends, a doctor had administered to him an injection with a substance which he believed were multivitamins to assist in running.
The Panel considers the Athlete’s statement and that he admitted the violation. The Panel concludes that the Athlete deliberately had used a prohibited substance without grounds for a reduced sanction. Therefore the Judiciary Office of the Kenya Sports Disputes Tribunal decides on 20 September 2018 to impose a 4 year period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. on 7 July 2017.
