In July 2017 the Anti-Doping Agency of Kenya (ADAK) has reported an anti-doping rule violation against the Athlete Nelly Jepkurui Kibet after her sample tested positive for the prohibited substances Prednisolone and Prednisone. After notification a provisional suspension was ordered. The Athlete filed a statement in her defence and she was heard for the Judiciary Office of the Kenya Sports Disputes Tribunal.
The Athlete admitted the violation, accepted the test results and denied the intentional use of the substances. She explained with evidence from her doctor that she underwent medical treatment in a hospital where prescribed medication were administered for her condition. Afterwards she failed to mention her medication on the Doping Control Form nor was she aware to apply for a TUE.
The Panel accepts the Athlete’s statement and evidence and concludes that the violation was not intentional. Therefore the Judiciary Office of the Kenya Sports Disputes Tribunal decides on 16 October 2018 impose a 20 month period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. on 3 July 2017.
