AIn July 2018 the Anti-Doping Agency of Kenya (ADAK) has reported an anti-doping rule violation against the Kenyan volleyball player Jackline Nabwire Barasa after her sample tested positive for the prohibited substance Terbutaline.
After notification a provisional suspension was ordered.
The Athlete filed a statement in her defence and she was heard for the Sports Disputes Tribunal of Kenya.
The Athlete denied the intentional use of the substance and stated that she had used prescribed medication as treatment for her illness in May 2018 at the time she was tested. She asserted that she mentioned her medication on the Doping Control Form, that she was tested before without issues and that she was now a retired volleyball player.
The Tribunal established that the Athlete was not retired as asserted and accordingly subjected to the anti-doping rules. The Tribunal finds that the violation was not intentional, considers that she mentioned her medication on the Doping Control Form and deems that she acted with No Significant Fault or Negligence.
Therefore the Sports Disputes Tribunal of Kenya decides on 1 August 2019 to impose a 14 month period of ineligibility on the Athlete starting on 3 Augusust 2018.
