ADAK 2019 ADAK vs Willy Kipkemoi Rotich

In October 2018 the IAAF Athletics Integrity Unit reported an anti-doping rule violation against the Kenyan Athlete Willy Kipkemoi Rotich after his A and B samples tested positive for the prohibited substances Prednisolone and Prednisone. After notification the case was transferred to the Anti-Doping Agency of Keny (ADAK) in December 2018 and a provisional suspension was ordered.

Hereafter the Athlete failed to respond to the ADAK communications, he failed to file a statement in his defence nor did attend the hearing of the Kenya Judiciary Office of the Sports Disputes Tribunal.

The Panel holds that the test results established the presence of prohibited substances in the Athlete’s samples and accordingly that the Athlete committed an anti-doping rule violation. The Panel finds that the Athlete had been duly notified and without any response he failed to establish that the violation was not intentional.

Therefore the Tribunal decides on 16 October 2019 to impose a 4 year period of ineligibility on the Athlete starting on 11 December 2018.
