In December 2018 the Anti-Doping Agency of Keny (ADAK) has reported an anti-doping rule violation against the Athlete Jedidah Wanjiru Karungu after her sample tested positive for the prohibited substance 19-norandrosterone (Nandrolone). After notification a provisional suspension was ordered. The Athlete filed a statement in her defence and she was heard for the Kenya Judiciary Office of the Sports Disputes Tribunal.
The Athlete accepted the test result and denied the intentional use of the substance. She stated that she had mentioned her medication she had used on the Doping Control Form and acknowledged that she forgot to mention the use of the prescribe medication Primolut N as possible source of the positive test. She explained that after she tested positive she became aware that this product contained the substance Norethisterone. Further she produced evidence about the medical treatments she underwent and the prescribed medication she had used in 2018.
The Panel regards that the Athlete had not received anti-doping education and that she was tested before. The Panel holds that when tested in 2018 she didn’t mention all her prescribed medications and her medical treatments on the Doping Control Form. Also it appears that she failed to check her medication for prohibited substances before using. Considering the Athlete's conduct in this case the Panel concludes that the Athlete failed to establish that the violation was not intentional nor how the substance entered her system.
Therefore the Panel decides on 17 October 2019 to impose a 4 year period of ineligibility on the Athlete starting on 20 December 2018, i.e. the date of the provisional suspension.
