ADAK 2021 ADAK vs Joan Nancy Rotich

In February 2019 the Anti-Doping Agency of Keny (ADAK) has reported an anti-doping rule violation against the Athlete Joan Nancy Rotich after her sample tested positive for the prohibited substance 19-norandrosterone (Nandrolone). After notification a provisional suspension was ordered. The Athlete filed a statement in her defence and she was heard for the Kenya Judiciary Office of the Sports Disputes Tribunal.
The Athlete admitted the violation and stated that she had used Deca-Durabolin tablets purchased in a supplement shop in Indonesia. She could not indicate the name of the shop nor could she provide evidence of the purchase. After she tested positive she became aware that she had used a prohibited substance. She asserted that she had no knowledge of prohibited substances and had not received anti-doping education.
ADAK accepted that het Athlete established the source of the positive test but also contended that the Athlete had acted negligently. While she was tested before she made no effort to conduct any research on her supplements for prohibited substances.
The Panel considered the Athlete’s conduct in this case and concludes that she failed to establish on the balance of probability that the violation was not intentional, nor established how the prohibited substance entered her system. Therefore the Panel decides on 17 October 2019 to impose a 4 year period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. on 27 February 2019.
