In September 2017 the Anti-Doping Agency of Keny (ADAK) has reported an anti-doping rule violation against the Athlete Selly Jepkurui Korir after her sample tested positive for the prohibited substance Oxycodone.

After notification a provisional suspension was ordered. The Athlete filed a statement in her defence and she was heard for the Kenya Judiciary Office of the Sports Disputes Tribunal.

The Athlete admitted the violation and denied the intentional use of the substance. She explained that in May 2017 during the marathon in China she collapsed. She underwent medical treatment for her condition in a Chinese hospital and had used prescribed medication of which Oxycone was used 1 tablet per day. She acknowledge that she did mention only one medication on the Doping Control From because she had left her medications in the hotel and the information was written in Chinese.

The Panel accepts that the violation was not intentional because the Athlete collapsed during the Marathon in China and needed medical treatment. The Panel further holds that the Athlete acted negligently due to she didn’t mention to her doctor that she was an Athlete subjected to Doping Control. Although her prescribed medication was in another language, the Panel regards that the Athlete failed to reseach her medication for prohibited substances before using.

Therefore the Panel decides on 23 October 2019 to impose a 2 year period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. from 15 September 2018.
