In December 2018 the Anti-Doping Agency of Keny (ADAK) has reported an anti-doping rule violation against the Athlete Emmy Chepkirui after her sample tested positive for the prohibited substance 19-norandrosterone (Nandrolone). After notification a provisional suspension was ordered. The Athlete filed a statement in her defence and she was heard for the Kenya Judiciary Office of the Sports Disputes Tribunal.
The Athlete gave a prompt admission and denied the intentional use of the substance. She demonstrated with medical information that in 2018 and in 2019 she underwent medical treatments in hospitals and had used prescribed medication for malaria, typhoid and a leg fracture. She assumed that the medication she used was the source of the postitive test and acknowledged that she didn’t mention to her doctors that she was an Athlete.
The Panel accepts that the Athlete’s violation was not intentional and finds that the Athlete could establish how the prohibited substance entered her system. The Panel holds that the Athlete acted negligently since she failed to inform her doctors that she was an Athlete and failed to get acquainted with the anti-doping rules.
Therefore the Panel decides on 4 December 2019 to impose a 2 year period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. on 11 December 2018.
