In December 2018 the Anti-Doping Agency of Kenya has reported an anti-doping rule violation against the Athlete Rholex Jelimo Kogo after her sample tested positive for the prohibited substances Prednisone and Prednisolone. After notification a provisional suspension was ordered. The Athlete filed a statement in her defence and she was heard for the Judiciary Office of the Sport Disputes Tribunal.
The Athlete admitted the violation and denied the intentional use of the subsances. She explained that she underwent medical treatment for her health problems and had used prescribed medication which she had mentioned on the Doping Control Form. She requested for a reduced sanction and acknowledged that she failed to indicate to her doctor that she was and Athlete nor had she researched her medication before using.
The Panel accepts that the violation was not intentional, that the Athlete established how the substances entered her system but also finds that she acted negligently. Therefore the Sports Disputes Tribunal decides on 27 February 2020 to impose a 2 year period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. on 27 December 2018.
