In February 2020 the United States Anti-Doping Agency (USADA) has reported an anti-doping rule violation against the wrestler Daton Fix after his A and B samples tested postive for the prohibited substance Ostarine in a very low concentration. After notification a provisional suspension was ordered and the Athlete requested for a hearing.
The Athlete accepted the test result and denied the intentional use of the substance. Analysis of his supplements in a Lab did not reveal prohibited substances. After conversation with his father the Athlete could prove how the substance had entered his system.
The Athlete asserted that the positive test must have been caused by accidentally ingesting some of his father's Ostarine as a result of drinking from a water bottle mixed with Vasayo and Ostarine while visiting his parents' home, either in the days before his competition in Italy or in the days following his return to Oklahoma.
The Salt Lake City Lab confirmed the presence of Ostarine in the supplement the Athlete's father had used to mix with Vasayo and USADA accepted that the Athlete's ingestion of Ostarine was accidental and not intended to enhance his performance.
The Parties in this case reached an agreement to settle the matter into a Consent Award issued by the Panel of the American Arbitration Association (AAA).
The Panel finds that the Athlete has satisfied his burden of proving by a balance of probability how the Ostarine entered his system. Further he demonstrated that the violation was not intentional with only a light degree of fault in this case.
Therefore the AAA Panel decides on 31 August 2020 to impose a 12 month period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. on 10 February 2020.
