CCES 2021 CCES vs Philippe Marcil

In October 2021 the Canadian Centre for Ethics in Sport (CCES) has reported an anti-doping rule violation against the powerlifter Philippe Marcil after his sample tested positive for the prohibited substance Tamoxifen.

After notification a provisional suspension was ordered and the Athlete only indicated that he was willing to waive his right for a hearing and to accept a sanction proposed by the CCES. Yet he  failed to confirm this in writing within the set deadline.

Because the Athlete failed to dispute the asserted violation within the deadline under the Rules follows that the Athlete is deemed to have admitted the violation, to have waived his right for a hearing and to have accepted the proposed consequences.

Therefore the CCES decides on 5 November 2021 to impose a 2 year period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. on 4 October 2021.
