TJD-AD 2018-079 Disciplinary Decision - Bodybuilding
September 27, 2018
On 27 September 2018 the TJD-AD decided to impose a 4 year period of ineligibility on the bodybuilder after he tested positive for the prohibited substances Anastrozole, Drostanolone and Oxandrolone.
In first instance the Athlete admitted the violation and denied the intentional use of the substances. Because of the delays in the proceedings not attributed to the Athlete the start of the sanction was backdated to the date of the sample collection, i.e. on 9 December 2017.
Hereafter in October 2018 the Athlete appealed the Decision with the TJD-AD Appeal Tribunal and requested for a reduced sanction based on No Fault or Negligence.
The Brazilian Doping Control Authority (ABCD) rejected the Athlete's appeal and contended that there was sufficient evidence that the Athlete had used multiple prohibited substances without grounds for a reduced sanction.
The TJD-AD Rapporteur agrees that there are no grounds for a reduced sanction and establishes that the Athlete had provided a partial admission for only 2 substances he had used.
Therefore the TJD-AD Appeal Tribunal decides on 29 December 2018 to dismiss the Athlete's appeal.
