UKAD 2023 UKAD vs Ashley Calvert

In August 2022 the United Kingdom Anti-Doping has reported an anti-doping rule violation against the ice hockey player Ashley Calvert after his sample tested positive for the prohibited substances Morphine, Oxycodone and Oxymorphone.

The Athlete was invited by UKAD to apply for a retroactive TUE. However he only submitted a partially completed retroactive TUE application.

Following notification a provisional suspension was ordered and the case was referred to the National Anti-Doping Panel. The Athlete failed to respond and the case was settled based on the written submissions of the parties.

UKAD accepted that the violation was not intentional and deemed that the Athlete acted negligently. He failed to explain his use of these substances with corroborating evidence and he failed to obtain a retroactive TUE.

The Panel finds that the presence of the prohibited substances had been established in the Athlete's sample and accordingly that he committed an anti-doping rule violation. The Panel determines that the violation was not intentional and that there are no grounds for a further reduction of the sanction.

Therefore the National Anti-Doping Panel decides on 18 May 2023 to impose a 2 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 10 August 2022.
