On 25 September 2013 the Royal Dutch Cycling Federation (KNWU) Disciplinary Committee decided to impose only a reprimand on the Athlete after his 2 samples, provided in May 2013, tested positive for the prohibited substance methylhexaneamine (dimethylpentylamine). Hereafter the manufacturer reported that the complete batch of the supplement, used by the Athlete, was contaminated with this prohibited substance.
In August 2013 the Royal Dutch Cycling Federation (KNWU) has reported a second anti-doping rule violation against the Athlete after his sample again tested positive for the prohibited substance methylhexaneamine (dimethylpentylamine). At the time that the sample was provided in July 2013, the Athlete was already involved in the proceedings of the first anti-doping rule violation.
Previously in July 2013, the Athlete decided to participate in a competition in spite of:
- he was confronted with two anti-doping rule violations;
- no test results of his supplements in the first violation case were yet available; and
- the source of the positive test was still unknown.
After the Athlete was noticed of the first anti-doping rule violation, a provisional suspension was ordered in August 2013. Due to the report of the second anti-doping rule violation, the ordered provisional suspension continued. The Athlete filed a statement in his defence and was heard for the KNWU Disciplinary Committee.
The Athlete stated that he suffered from a break down after the notifice of the anti-doping rule violation and he participated in the competition in July 2013 due to pressure of his team athletes
The Committee considers the circumstances and concludes that the Athlete acted negligently and careless without intention to enhance his sport performance.
Therefore the KNWU Disciplinary Committee decides to impose a 18 month period of ineligibility on the Athlete, starting on the date of the provisional suspension.
Fees and expenses for this committee shall be borne by the Athlete and the KNWU.
