The French Swimming Federation (Fédération Française de Natation, FFN) charges respondent M49 for a violation of the Anti-Doping Rules. During a swimming event on December 17, 2006, respondent didn't attend the doping control.
History
The respondent was unable to produce enough urine for a sample and was asked to return later. He didn't return to the doping control room and explained by phone he was a diabetic and had no desire to urinate. Also he is not satisfied with the room where the doping test took place. In his defence respondent claims not to have been explicitly informed by the sampler he should remain at the disposal of the latter to provide a complementary urine sample.
The panel takes note that respondent didn't sign the doping control papers, also it can't be ignored that respondent evaded the doping control on purposes. Respondent is also a sport educator, which means he is more then aware of the rules regarding doping control.
Decision
1. The sanction is a period of ineligibility of one year in which respondent can't take part in competition or manifestations organized by the FFN.
