ISR 2009 NHB Preliminary Decision Disciplinary Committee 2009049 TU
January 12, 2010
The Dutch Archery Federation (NHB) has reported against this person for violating the Anti-Doping Rules of the ISR during the Dutch Championships Field Archery. In the A portion of the urine sample of the person concerned the substance Atenolol was found. This is confirmed in the analysis of the B portion of the urine sample. Atenolol is a category prohibited list P2 substance. Beta-blockers are prohibited in-competition in a number of sports, including archery. Person concerned has declared on defence not to appreciate an oral hearing of the disciplinary matter. The Disciplinary Committee therefore treated the matter without the presence of the person in question.
In an interim decision, the Disciplinary Commission provided the person concerned a large period of six weeks in which the athlete could apply for a TUE. After six weeks, the application for TUE was still in progress therefore the Disciplinary Committee provided an additional six weeks to obtain dispensation. However, after twelve weeks in total a TUE could not been shown to the Disciplinary Committee. Since there was no valid dispensation certificate the Disciplinary Commission followed up on an anti doping rule violation.
Beta blockers are categorized as “specified substances" within the prohibited list. Within this category the exclusion period can be reduced if certain conditions are met. The defence of the person concerned, according to the Disciplinary Committee sufficiently established that the prohibited substance in the body is the cause of medical drug use. These medications are used on medical grounds and not for sport performance. The Disciplinary Committee is of the opinion that the person meets certain conditions and considered that a penalty consisting of a warning accompanied by a reprimand is in place. Also that the handling costs of this case were charged to the person concerned.
