World Athletics 2022 WA vs Mathew Kipkoeck Kisorio

In March 2022 the Athletics Integrity Unit (AIU) of World Athletics has reported an an anti-doping rule violation against the Kenyan Athlete Mathew Kipkoeck Kisorio for his 3 Whereabouts Filing Failures and 1 Missed Test within a 12 month period, beginning in February 2021.

In this matter the Athlete failed to respond or provided insufficient explanations, nor requested an administrative review. Previously the Ahtlete had been sanctioned for 2 years in July 2012 for the presence of a prohibited substance.

After notification a provisional suspension was ordered while the Athlete failed to respond to the communications of the AIU. Because the Athlete failed to respond to the charge within the set deadline the AIU deems that the Athlete has admitted the anti-doping rule violation, waived his right for a hearing and accepted the consequences thereupon.

Therefore the AIU decides on 15 April 2022 to impose a 4 year period of ineligibility on the Athlete for his second anti-doping rule violation, starting on the date of the provisional suspension, i.e. 8 March 2022.

World Athletics 2022 WA vs Mark Otieno Odhiambo

In July 2021 the International Olympic Committee (IOC) and in August 2021 the Anti-Doping Agency of Kenya (ADAK) reported anti-doping rule violations against the Kenyan Athlete Mark Otieno Odhiambo after his samples tested positive for the prohibited substance Methasterone.

The Athlete provided a sample in Kenya in June 2021 and a second sample in July 2021 during the Tokyo Olympic Games. After notification in July 2021 a provisional suspension was ordered and the CAS ADD deemed on 22 November 2021 that the Athlete had committed an anti-doping rule violation. Both IOC and ADAK referred their cases to the Athletics Integrity Unit (AIU).

The Athlete believed that a contaminated supplement was the source of the positive tests and with evidence he showed that he had purchased and used the supplement Amino Hardcore in Kenya. Thereupon analysis of this supplement confirmed the presence of Methasterone in this product.

The Athlete asserted that he continuously exercised extreme caution of products before purchasing and using supplements and he mentioned the use of this supplement on the Doping Control Form.

Hereafter both parties were unable to reach a settlement of the matter in July 2022. Following the Notice of Charge in August 2022 the Athlete filed a statement in his defence and he was heard for the Disciplinary Tribunal.

The Athlete denied the intentional use of the substance and argued that a comtaminated supplement was the source. Further he asserted that there had been a departure of the ISL by the Bloemfontein Laboratory and that the CAS ADD had breached the principles of natural justice.

Word Athletics contended that there was no departure of the ISL by the Bloemfontein Laboratory wheras the Athlete had not disputed the validity of the positive test for Methasterone reported by this Laboratory.

World Athletics denied that previously the CAS ADD had violated any principles of natural justice. Moreover the Panel addressed the Athlete's arguments in this matter and concludes that the progress of the CAS ADD proceedings was entirely straightforeward and proper.

Following assessment of the evidence and the Athlete's conduct in this case the Panel finds that the Athlete had demonstrated that the source of the positive test was the supplement Amino Hardcore and that the prohibited substance was not disclosed on the product label.

The Panel determines that the Athlete's violation was not intentional and that both anti-doping rule violations shall be considered together as one single first violation. Furthermore the Panel concludes that the Athlete did not manifestly disregard the risk of contamination and made a reasonable Internet search regarding the supplement Amino Hardcore.

Nevertheless a majority of the Panel finds that there are no grounds for No Significant Fault or Negligence because the Athlete had not exercised a high level of caution before using the contamined product.

Therfore on 7 December 2022 the Disciplinary Tribunal decides to impose a 2 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 31 July 2021.

World Athletics 2022 WA vs Mark Kangogo

In September 2022 the Athletics Integrity Unit (AIU) on behalf of World Athletics has reported an anti-doping rule violation against the Kenyan Athlete Mark Kangogo after his sample tested positive for the prohibited substances 19-norandrosterone (Nandrolone) and Triamcinolone acetonide.

After notification the Athlete gave a prompt admission, waived his right for a hearing, accepted a provisional suspension and the sanction proposed by the AIU.

The Athlete stated that he had used supplements and medication for the treatment of an ankle injury. Yet, none of them listed the prohibited substances in their ingredients.

Because the Athlete signed and submitted the Admission of Anti-Doping Rule Violations and Acceptance of Consequences Form he received a 1 year reduction from the AIU.

Therefore the AIU decides on 12 October 2022 to impose a 3 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 9 September 2022.

World Athletics 2022 WA vs Marius Kipserem

In September 2022 the Athletics Integrity Unit (AIU) on behalf of World Athletics has reported an anti-doping rule violation against the Kenyan Athlete Marius Kipserem after his sample tested positive for the prohibited substance Erythropoietin (EPO).

After notification the Athlete gave a prompt admission, waived his right for a hearing, accepted a provisional suspension and the sanction proposed by the AIU.

The Athlete denied the intentional use of EPO, yet could not explain how the substance had entered his system.

Because the Athlete submitted and confirmed the Admission of Anti-Doping Rule Violations and Acceptance of Consequences Form he received a 1 year reduction from the AIU.

Therefore the AIU decides on 18 October 2022 to impose a 3 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 22 September 2022.

World Athletics 2022 WA vs Maksim Sidorov

In 2016, Professor Richard McLaren issued two reports about systemic doping in Russia. These reports identified a significant number of Russian athletes who were involved in, or benefitted from, the doping schemes and practices that he uncovered.

Hereafter in January 2019 the World Anti-Doping Agency (WADA) recovered the internal database of the Moscow Laboratory (LIMS). Following investigation of allegations of organized doping practices, and in particular of the LIMS, WADA provided international federations with investigation reports on the athletes implicated in these organized doping practices.

These investigation reports revealed that a prohibited substance has been established in the 2 samples of the Athlete Maksim Sidorov. These samples were provided by the Athlete in 2012 and thereupon deliberately reported as negative by the Moscow laboratory.

As a result in July 2022 the Athletics Integrity Unit (AIU), on behalf of World Athletics, reported anti-doping rule violations against the Athlete for the use of the prohibited substance Oxandrolone in 2012. After notification the Athlete failed to respond to the AIU communications.

Without the Athlete's response the AIU deems that he has waived his right to a hearing, to have accepted the asserted anti-doping rule violations and the sanction rendered by the AIU. The AIU considers that there are aggravating circumstances present in this case that justifies the imposition of a more severe sanction.

Furthermore the AIU determines that the Athlete previously was sanctioned with a period of ineligibility of 1 year from 3 July 2017 until 2 July 2018. In the present case the AIU shall count the reported 2012 anti-doping rule violations as single first violation together with the 2017 first violation.

Therefore the AIU decides on 20 March 2023 to impose an additional 3 year period of ineligibility on the Athlete, starting on the date of the decision. All the Athlete's results from 15 July 2012 until 3 July 2017 are disqualified with all of the resulting consequences, including forfeiture of any medals, titles, points, prize money and prizes.

World Athletics 2022 WA vs Maiyo Johnstone Kibet

In July 2022 the Athletics Integrity Unit (AIU) on behalf of World Athletics has reported an anti-doping rule violation against the Kenyan Athlete Maiyo Johnstone Kibet after his sample tested positive for the prohibited substance Erythropoietin (EPO).

After notification the Athlete gave a prompt admission, waived his right for a hearing, accepted a provisional suspension and the sanction proposed by the AIU. The Athlete did not demonstrate that the violation was not intentional. He explained that he had received an iron injection and used a painkiller and a vitamin supplement.

Because the Athlete signed and submitted the Admission of Anti-Doping Rule Violations and Acceptance of Consequences Form he received a 1 year reduction from the AIU.

Therefore the AIU decides on 19 December 2022 to impose a 3 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 20 July 2022.

World Athletics 2022 WA vs Lilian Kasait Rengeruk

In February 2022 the Athletics Integrity Unit (AIU) on behalf of World Athletics has reported an anti-doping rule violation against the Kenyan Athlete Lilian Kasait Rengeruk after her sample tested positive for the prohibited substance Letrozole.

After notification the Athlete gave a prompt admission, waived her right for a hearing, accepted a provisional suspension and the sanction proposed by the AIU. Hereafter the Athlete, the AIU and WADA entered into a Case Resolution Agreement.

Therefore the AIU decides on 21 September 2022 to impose a 10 month period of ineligibility on the Athlete, starting backdated on 19 April 2022.

World Athletics 2022 WA vs Keneth Kiprop Renju

In April 2022 the French Anti-Doping Agency (AFLD) has reported an anti-doping rule violation against the Kenyan Athlete after his sample - provided in March 2022 - tested positive for the prohibited substance Methasterone.

Thereupon in October 2022 the Athletics Integrity Unit (AIU) on behalf of World Athletics has reported anti-doping rule violations against the Athlete after his two samples - provided in April and in May 2022 - also tested positive for Methasterone.

After notification both AFLD and AIU ordered a provisional suspension on the Athlete. In September 2022 the AFLD transferred its case to the AIU for reasons of procedural efficiency.

Previously in May 2022 the AFLD had contacted the Athlete about the first positve test and reported that he had participated in two competitions during the Provisional Suspension. The Athlete explained that he was unaware of the Notification and Provisional Suspension.

The Athlete produced evidence regarding the medical treatment he underwent in March 2022, yet the AFLD determined that this treatment could not explain the presence of Methasterone in his sample. Further the AIU established that the Athlete's 3rd positive test could not have been caused by a single administration of Methasterone in March 2022.

Ultimately in October 2022 the Athlete admitted the violation, waived his right for a hearing and accepted the sanction proposed by the AIU. Because the Athlete signed and submitted the Admission of Anti-Doping Rule Violations and Acceptance of Consequences Form he received a 1 year reduction from the AIU.

In view of the evidence the AIU deemed that there were grounds for the application of aggravating circumstances because the Athlete had used a prohibited substance on multiple occasions. Therefore the AIU decides on 11 November 2022 to impose a 5 year period of ineligibility on the Athlete, starting on 13 May 2022.

World Athletics 2022 WA vs Kamalpreet Kaur

In March 2022 the Athletics Integrity Unit (AIU) on behalf of World Athletics has reported an anti-doping rule violation against the Indian Athlete Kamalpreet Kaur after her sample tested positive for the prohibited substance Stanozolol.

After notification a provisional suspension was ordered and the Athlete conducted an investigation into the source of the substance. Analysis of her supplements in a private laboratory in India and in the accredited New Delhi Lab revealed the presence of Stanozolol in a Protein Supplement.

Thereupon the AIU assessed the Athlete's statements regarding the Protein Supplement and finds that the concentration in her sample was not consistent with the use of this supplement as documented and explained by the Athlete. Consequently the AIU deems that the Athlete failed to establish that the violation was not intentional, nor how the substance had entered her system.

Hereafter the Athlete gave a prompt admission, waived her right for a hearing and accepted the proposed sanction. Because she signed and submitted the Admission of Anti-Doping Rule Violations and Acceptance of Consequences Form she received a 1 year reduction from the AIU.

Therefore the AIU decides on 11 October 2022 to impose a 3 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 29 March 2022.

World Athletics 2022 WA vs Justus Kimutai

In March 2022 the Athletics Integrity Unit (AIU) of World Athletics has reported an an anti-doping rule violation against the Kenyan Athlete Justus Kimutai for his Whereabouts Filing Failure and 4 Missed Tests within a 12 month period, beginning in December 2020.

After notification a provisional suspension was ordered while the Athlete failed to respond to the communications of the AIU. Because the Athlete failed to respond to the charge within the set deadline the AIU deems that the Athlete has admitted the anti-doping rule violation, waived his right for a hearing and accepted the consequences thereupon.

Therefore the AIU decides on 15 April 2022 to impose a 2 year period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. 4 March 2022.
