AFLD 2009 FFB vs Respondent M11

Facts
The French Federation of Billiards (Fédération Française de Billard, FFB) charges respondent M11 for a violation of the Anti-Doping Rules. During a contest on June 29, 2008, a sample for a doping test was taken. The sample tested positive for metabolites of cannabis and cocaine. Cannabis and cocaine are prohibited substances according the World Anti-Doping Agency (WADA) prohibited list. Cannabis is regarded as a specified substance.

History
The respondent had received a sanction in a decision, dated October 11, 2008, of one year period of ineligibility, with three months under conditions, by the disciplinary committee of the FFB. Respondent didn't supply any information about how the prohibited substances had entered his body. But he has no intention to stop his use of cannabis.

Decision
1. The sanction is a period of ineligibility of two years in which the respondent can't take part in competition or manifestations organized or authorized by the FFB.
2. The period of ineligibility should be reduced by the time already served by voluntary suspension and by the sanction of October 11, 2008.
3. The decision starts on the date of notification.
4. The decision will be published and sent to the parties involved.

In November 2013 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Raluca Ionela Irimia after her sample tested positive for the prohibited substance dexamethasone.

At the hearing the Athlete stated she suffered from a shoulder injury since September 2013 and therefore is treated with dexamethasone, prescribed and administrated intravenously by her doctor Victoria Tigirlas. She also mentioned the use of the substances ketonal and dexamethasone on the Doping Control Form. The Athlete stated that she didn’t know that the substance dexamethasone is prohibited and that she could apply for a Therapeutic Use Exemption (TUE).
The doctor Victoria Tigirlas sustained the Athlete’s statement and the intravenously administration of ketonal and dexamethasone due to the Athlete's shoulder injury. The doctor also presented the Athlete’s medical file to the Hearing Commission.

Considering the circumstances the ANAD Hearing Commission decides to impose a 1 month period of ineligibility on the Athlete, starting on the date of the hearing, i.e. 2 December 2013.

In November 2013 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Sorin Gabriel Ticudean after his out-of-competition sample tested positive for the prohibited substance trenbolone.
After notification the Athlete failed to attend the hearing of the ANAD Hearing Commission.

Due to this is the Athlete’s second violation, committed during the 2 year period of ineligibility, imposed on 14 January 2013, the ANAD Hearing Commission therefore decides to impose a lifetime period of ineligibility on the Athlete, starting on the date of the decision.

In October 2013 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Ioan Cojocari-Taut after his sample tested positive for the prohibited substance metenolone.
After notification a provisional suspension was ordered and the Athlete was heard for the ANAD Hearing Commission.
The Athlete admitted he used tablets, recommended by a an acquaintance, but he stopped using these tablets due to he did not feel well after administration.
The ANAD Hearing Commission decides to impose a 2 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. 18 November 2013.

In October 2013 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Alexandru Draghici after his sample tested positive for the prohibited substance methylhexaneamine (dimethylpentylamine).

At the hearing the Athlete stated he used a supplement Neurocore, recommended by a friend and purchased on the internet. The label of the product mentioned the ingredient Geranium Extract but not the substance methylhexaneamine. Also the Athlete argued that he practices recreational sport only.

The Commission considered that the Athlete had no intention to enhance sport performance and that the synonym Geranium for methylhexaneamine is not mentioned in the Prohibited List or on the WADA website.
Therefore the ANAD Hearing Commission decides to impose a 3 month period of ineligibility on the Athlete, starting on the date of the decision.

The Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Coach Augustin Barbu for complicity due to the anti-doping rule violations committed by two Athletes he trained.

The sample of the Athlete Maxim Simona Raula tested positive for the prohibited substance erythropoietin (EPO) and she left the trainingcamp prior to a doping control with the coach his approval.
Hereafter the Coach gave inconclusive and contradictory statements about the Athlete’s absence. Considering the circumstances the ANAD Hearing Commission imposed a 4 year period of ineligibility on the Athlete Maxim Simona Raula.
Due to the sample of the second Athlete Roxana Elisabeta Birca tested positive for the prohibited substance methastrone, the ANAD Hearing Commission imposed a 2 year period of ineligibility.

Considering there is no acceptable evidence the ANAD Hearing Commission decides to impose no ineligibility on the coach Augustin Barbu.

In July 2013 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Roxana Elisabeta Birca after her A and B samples tested positive for the prohibited substances methasterone.
After notification a provisional suspension was ordered the Athlete was heard for the ANAD Hearing Commission.
The Athlete and her coach stated they could not explain the presence of the prohibited substance in her sample.
The ANAD Hearing Commission decides to impose a 2 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 5 September 2013.

In September 2013 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Josef Gabor after his sample tested positive for the prohibited substances amiloride, hydrochlorothiazide and testosterone with a T/E ratio above the WADA threshold.
After notification the Athlete filed a statement in his defence and did not attend the hearing of the ANAD Hearing Commission.
The Athlete admitted the use of the prohibited substances and did not request the B sample analysis.
The ANAD Hearing Commission decides to impose a 2 year period of ineligibility on the Athlete, starting on the date of the decision.

At the hearing the Athlete admitted the use of the prohibited substance and did not request the B sample analysis.

In June 2013 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Paul Nicolae Catruna after his sample tested positive for the prohibited substance clenbuterol.
After notification the Athlete failed to respond nor did het attend the hearing of the ANAD Hearing Commission.
Due to this is the Athlete’s second violation the ANAD Hearing commission decides to impose a lifetime period of ineligibility on the Athlete, starting on the date of the decision.
