FILA 2010 WADA vs FILA & Radomir Petrovic

On 17 September 2010 the FILA Sport Judge imposed a 12 month period of ineligibility on the Serbian Athlete Radomir Petkovic after is sample tested positive for the prohibited substance methandienone.
Hereafter WADA appealed the FILA decision of 17 September 2010 with the FILA Appeal Commission.

The Athlete stated that he suffered from a headache and his mother was at fault due she gave him his father’s medication instead of a supplement to treat his headache which she kept together at one place.

The Appeal Commission concludes that the Athlete acted negligently and rejects his statement.
Therefore the FILA Appeal Commission decides to set aside the decision of the FILA Sport Judge and to impose a 2 year period of ineligibility on the Athlete, starting on the date of the sample collection, i.e. 29 May 2010.

AFLD 2011 FSGT vs Respondent M12

Facts
The French Federation of Workers and Amateurs in sports (Fédération Sportive et Gymnique du Travail (FSGT) charges Respondent M12 for a violation of the Anti-Doping Rules. During a swimming contest a sample was taken for doping test purposes. The analysis showed the presence of terbutaline. Terbutaline is a prohibited substance according the World Anti-Doping Agency (WADA) prohibited list and is regarded as a specified substance.

History
The respondent used medication to treat asthma which he has since childhood, this was mentioned on the filling form of the doping control.

Decision
1. The respondent is acquitted.
2. The present decision will start on the date of notification.
3. The decision will be published and sent to the parties involved.

BOC 2013_5 WADA vs Alex Zlatomirov Ivanov

On 20 May 2013 the Disciplinary Commission of the Bulgarian Olympic Committee decided to impose a 6 month period of ineligibility on the Athlete Alex Zlatomirov Ivanov after his sample tested positive for the prohibited substance methandienone.

Hereafter WADA appealed the decision of the Disciplinary Commission with the Bulgarian Sport Arbitration (BSA) of the Bulgarian Olympic Committee. WADA requested BSA to set aside the decision of the Disciplinary Commission and to impose a 1 year period of ineligibility on the Athlete. WADA argued there were no grounds to impose a less severe sanction on the Athlete.

The Athlete stated that he used multivitamins which were contaminated with the prohibited substance. The Athlete showed he has a chronic disease and therefore acted vigilant with supplements and argued that the prohibited substance is not mentioned as ingredient on the label of the product.

The BSA concludes that the imposed sanction by the Disciplinary Commission does not match in any regulation and has been set in violation with of the rules, due to the found prohibited substance is not listed as specific substance in the WADA 2013 Prohibited List.
Considering the circumstances the Bulgarian Sport Arbitration (BSA) of the Bulgarian Olympic Committee decides to set aside the decision of the Disciplinary Commission of the Bulgarian Olympic Committee and to impose a 1 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 22 April 2013.
