UKAD 2022 UKAD vs Anthony De Luca

In December 2021 the United Kingdom Anti-Doping (UKAD) has reported an anti-doping rule violation against the Canadian Ice Hockey player Anthony De Luca for presence and use after his sample tested positive for the prohibited substance Cannabis in a concentration above the WADA threshold (295 ng/mL).

After notification a provisional suspension was ordered. The Athlete filed a statement in his defence and he was heard for the National Anti-Doping Panel.

The Athlete admitted that he had used Cannabis daily in Canada until his arrival in England. He asserted that any use occurred out-of-competition in a context unrelated to sport performance.

UKAD contended that Athlete had used Cannabis at the material time on the day of the competition and that it was unlikely that the found concentration in his sample was attributed to his use before his arrival to England.

The Panel concludes that there was no evidence that the Athlete had used Cannabis at the material time on the day of the competition since the London Lab could not corroborate UKAD's contention in this matter. As a result the Panel deems that the Athlete had committed an anti-doping rule violation for the presence, not for the use of Cannabis.

Nevertheless the Panel also did not accept the Athlete's denial that he had not used Cannabis after his arrival in England two weeks before the competition. Further the Panel considers that the Athlete continued to play professionally in Canada while he was aware that a provisional suspension was ordered in the United Kingdom.

Therefore the National Anti-Doping Panel decides on 21 June 2022 to impose a 3 month period of ineligibility on the Athlete, starting on the date of the decision. This sanction could be reduced to 1 month if the Athlete satisfactorily completes a Substance of Abuse treatment program approved by UKAD.

UKAD 2022 UKAD vs Ashleigh Hyndman

In June 2022 United Kingdom Anti-Doping (UKAD) reported an anti-doping rule violation against the rugby player Ashleigh Hyndman after his A and B samples tested positive for the prohibited substance GW1516.

Following notification a provisional suspension was ordered. The Athlete filed a statement in his defence and he was heard for the National Anti-Doping Panel.

In this case there had been delays in the proceedings due to the extentions requested by the Athlete in order to obtain corroborating evidence for his defence.

Ultimately the Athlete admitted the violation and denied the intentional use of the substance. Supported by expert witnesses and evidence he asserted that a contaminated supplement was the source of the positive test results.

The Athlete had tested his supplement in question in a laboratory and analysis revealed the presence of GW1516 contaminants in a open package. Yet, no contaminants were detected in the sealed packages of this supplement.

The Athlete asserted that the concentration of the substance found in his supplement was consistent with contamination and inconsistent with deliberate sabotage. On the other hand UKAD's expert witness did not exclude the possibility of contamination in the manufacturing process but was neutral as to when it had occurred.

UKAD contended that the Athlete's violation was intentional and that he failed to establish the source of the prohibited substance.

The Panel assessed and addressed the evidence provided by the Parties and their expert witnesses. As a result the Panel was unable to be satisfied that the Athlete had established, to the standard required, the source of the substance he had ingested, nor that the violation was not intentional.

Nevertheless the Panel deems that the Athlete had been a credible witness, neither was he deemed to be a cheater. Further the Panel determines that delays in the proceedings had plainly impacted him in a very adverse way.

Therefore the Panel decides on 17 May 2023 to impose a 4 year period of inelgibility on the Athlete, starting on the date of the provisional suspension, i.e. on 10 June 2022.

UKAD 2022 UKAD vs Ben Harrison

In June 2021 United Kingdom Anti-Doping (UKAD) has reported an anti-doping rule violation against the rugby player Ben Harrison after his sample tested positive for the prohibited substance Drostanolone.

After notification a provisional suspension was ordered. The Athlete filed a statement in his defence and did not attend the hearing of the National Anti-Doping Panel.

The Athlete admitted the violation and denied the intentional use of the substance. He had returned to playing rugby after 10 September 2020 and asserted that the substance was used in the period when he was still retired from sport.

By contrast UKAD contended that the concentration of Drostanolone found in the Athlete's sample was not consistent with his alleged administration of the substance in the period when retired from all forms of rugby.

The Panel considers that the Athlete had admitted the use of the substance and had committed an anti-doping rule violation. The Panel deems that without any corroborating evidence the Athlete failed to demonstrate that the violation was not intentional.

Therefore the National Anti-Doping Panel decides on 6 September 2022 to impose a 4 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 11 June 2021.

UKAD 2022 UKAD vs Ben Solder

In May 2022 the United Kingdom Anti-Doping (UKAD) has reported an anti-doping rule violation against the ice-hockey player Ben Solder after his sample tested positive for the prohibited substance Cocaine.

After notification the Athlete gave a prompt admission, waived his right for a hearing, accepted a provisional suspension and the sanction proposed by UKAD.

The Athlete explained that he recreationally had used Cocaine  assuming he would not be playing in the competition two days later. UKAD accepts that the use of the substance occurred out-of-competition.

Because the Athlete demonstrated that he underwent a Substance of Abuse treatment program UKAD reduced the sanction down to one month.

Therefore UKAD decides on 26 July 2022 to impose a 1 month period of ineligibility on the Athlete. Because the Athlete already served the sanction he is deemed eligible to participate in sport forthwith.

UKAD 2022 UKAD vs Callum Marriott

In May 2022 United Kingdom Anti-Doping (UKAD) has reported an anti-doping rule violation against the rugby player Callum Marriott after his sample tested positive for the prohibited substances Enobosarm (Ostarine) and GW1516.

Following notification and charge the Athlete gave a prompt admission, waived his right for a hearing, accepted a provisional suspension and the sanction proposed by UKAD. Because the Athlete gave a timely admission of the anti-doping rule violation he received a 1 year reduction from UKAD.

Therefore on 10 January 2023 UKAD decides to impose a 3 year period of ineligibility on the Athlete, starting backdated on the date of the provisional suspension, i.e. on 4 May 2022.

UKAD 2022 UKAD vs Craig Campbell

In October 2018 police officers seized a quantity of Cocaine and cash in possession of the football coach Mr Campbell. Thereupon Mr Campbell was charged with an offence of supplying Cocaine.

Ultimately in September 2020 he pleaded guilty to the offence of supplying a controlled drug. The Court confiscated the Cocaine and cash and Mr Campbell was fined.

Consequently in December 2022 United Kingdom Anti-Doping (UKAD) reported anti-doping rule violations against Mr Campbell for possession and trafficking of a prohibited substance. Following notification a provisional suspension was ordered and the case was referred to the National Anti-Doping Panel.

In view of the Court conviction and Mr Campbell's admission in June 2021 UKAD contended that he had committed these violations. Also UKAD deemed that there are no grounds for a reduced sanction, although prior there had been delays, there has been no substantial delay in the hearing process attributed to UKAD.

Preliminary the Panel had dismissed in January 2023 Mr Campbell's request to have the provisional suspension lifted. Furthermore the Panel concludes that under the Scottish FA Anti-Doping Regulations the Panel has no discretion to impose a reduced sanction, nor that delays in this case was UKAD's fault.

Therefore the National Anti-Doping Panel decides on 20 June 2023 to impose a 4 year period of ineligibility on Mr Campbell, starting on the date of the provisional suspension, i.e. on 22 December 2022.

UKAD 2022 UKAD vs Douglas Steele

In May 2022 United Kingdom Anti-Doping (UKAD) has reported an anti-doping rule violation against the rugby player Douglas Steele after his sample tested positive for the prohibited substances Dehydrochlormethyltestosterone and 19-norandrosterone (Nandrolone).

Following notification and charge the Athlete gave a prompt admission, waived his right for a hearing, accepted a provisional suspension and the sanction proposed by UKAD. Because the Athlete gave a timely admission of the anti-doping rule violation he received a 1 year reduction from UKAD.

Therefore on 19 October 2022 UKAD decides to impose a 3 year period of ineligibility on the Athlete, starting backdated on the date of the provisional suspension, i.e. on 6 May 2022.

UKAD 2022 UKAD vs Jack Arnfield

In March 2021 United Kingdom Anti-Doping was informed that prior in 2018 criminal charges had been filed agains the boxer Jack Arnfield for possession of Cannabis with intent to supply.

Previously the British Boxing Board of Control (BBBofC) had suspended the Athlete's boxing licence in April 2018 because of the criminal proceedings. Thereupon un May 2018 the Athlete pleaded guilty and in November 2018 the Athlete received a 12 month prison sentence, which ended in November 2019.

Hereafter in Janauary 2020 the Athlete received a new professional boxing licence from the BBBofC. Following an interview in January 2022 UKAD reported in April 2022 anti-doping rule violations against the Athlete for possession and trafficking of Cannabis.

After notification the Athlete gave a prompt admission, waived his right for a hearing, accepted a provisional suspension and the sanction proposed by UKAD.

UKAD considers that in this case there were mitigating circumstances and that there had been delays in the proceedings not attributed to the Athlete. Further UKAD considers that the principle of lex mitior is applicable retroactively because the 2021 WADA Anti-Doping Code allows a 1 year reduction based on the Athlete's early admission and acceptance of sanction.

Therefore on 25 October 2022 UKAD decides to impose a 3 year period of ineligibility on the Athlete, starting backdated on the date of the BBBofC provisional suspension, i.e. on 15 April 2018.

UKAD 2022 UKAD vs Jonathan Magrin

In August 2022 United Kingdom Anti-Doping (UKAD) has reported an anti-doping rule violation against the rugby player Jonathan Magrin after his sample tested positive for the prohibited substances Aandrosterone, Etiocholanolone, Testosterone and its adiols.

Following notification and charge the Athlete gave a prompt admission, waived his right for a hearing, accepted a provisional suspension and the sanction proposed by UKAD. Because the Athlete gave a timely admission of the anti-doping rule violation he received a 1 year reduction from UKAD.

Therefore on 25 October 2022 UKAD decides to impose a 3 year period of ineligibility on the Athlete, starting backdated on the date of the provisional suspension, i.e. on 5 August 2022.

UKAD 2022 UKAD vs Joseph Lewis

In June 2022 the United Kingdom Anti-Doping (UKAD) reported an anti-doping rule violation against the rugby player Joseph Lewis after his sample tested positive for the prohibited substance Amfetamine.

Following notification a provisional suspension was ordered. The Athlete explained that he was diagnosed with ADHD and as treatment used prescribed medication, Elvanse-Adult, which contained Amfetamine.

Thereupon the Athlete's retroactive application for a TUE was denied. UKAD's Review Panel deemed that the Athlete had failed to make a TUE application in advance for his prescribed medication.

Hereafter in November 2022 the Athlete admitted the violation and denied the intentional use of the substance. In his defence the Athlete asserted that prior he had indeed had checked the medication and had attempted to apply for a TUE.

The Athlete acknowledged that prior for his prescribed ADHD medication Elvanse-Adult he only had checked whether the medication brand name was present on the WADA Prohibited List. A few months later he realised his mistake and became aware that the ingredient lisdexamfetamine in his medication was a prohibited substance.

The Athlete asserted that he was hampered in his effort to apply timely for a TUE because a different ADHD assessment was required with a waiting list of almost 6 months. While waiting for his assessment he continued to use his medication and to play rugby without a valid TUE.

In view of the evidence UKAD accepts that the Athlete's violation was not intentional. However due to his conduct UKAD concludes that he failed to establish No Significant Fault or Negligence.

Therefore UKAD decides on 17 August 2023 to impose a 2 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 14 June 2022.
