FIBA 2010 FIBA vs Vernard Hollins

The International Basketball Federation (FIBA) has reported an anti-doping rule violation against the Player after his sample tested positive for the prohibited substance hydromorphone.
After notification the Player filed a statement and evidence in his defence and was heard for the FIBA Disciplinary Panel.
The Player stated he suffers from RTC syndrome in both his shoulders since the summer of 2009 which occasionally causes him sharp pain. Therefore his family doctor prescribed him the medication Acetimophen with Hydrocodone (hydromorphone) for the pain. His doctor confirmed having prescribed the medication to the Player.
The Player argued he used the medication shortly before the game and stated that the Acetimophen with Hydrocodone must have been the source of the prohibited substance.
The Panel accepts Player’s statement and finds Player’s negligence truly insignificant. Therefore the FIBA Disciplinary Panel decides a 1 month period of ineligibility.

ITF 2010 ITF vs Andrei Plotniy

In March 2010, the Russian tennis player Andrei Plotniy admitted that he had committed an anti-doping rule violation after his sample tested positive for the prohibited substance Carphedon.

Consequently he accepted a 15 month period of ineligibility, starting on 1 November 2009. However in 2010 he participated in five tennis competitions authorized by the German tennis federation.

The representative of the player explained that his client wasn't aware he was no allowed to play tennis for a national association, he will return any prize money he obtained and will apologize to the tournament organizers.


The ITF decides on 20 September 2010 that:

1.) The results that Mr Plotniy obtained in the events are disqualified, and the ranking points awarded therein are forfeited, along with the following prize money;

2.) The original 15-month period of Ineligibility imposed on Mr Plotniy now starts over again as from the date of his last participation in the events noted above, i.e., 22 August 2010, so that it will end at midnight on 21 November 2011. As a result, until that date Mr Plotniy may not ‘play, coach or otherwise participate in any capacity in (a) a Covered Event, any other Event or Competition, or any other kind of function, event or activity (other than authorized anti-doping education or rehabilitation programs) authorized, organized or sanctioned by the ITF, the ATP, the WTA, or any National Association or member of a National Association; or (b) any Event or Competition authorized or organized by any professional league, or any international or national-level Event or Competition organization.’ (See Article M.10.1 of the Program). If he has any doubt as to exactly what this prohibition covers, or whether it covers a particular event in which he would like to participate, he should check with the ITF before participating in that event.

3.) In accordance with the Program, the foregoing decision that Mr Plotniy has violated the prohibited against participation while ineligible, and that a reduction under Article M.5.2 is not appropriate, may be appealed to the Court of Arbitration for Sport in accordance with Article O of the Program. Under Article O.5.1 of the Program, the deadline for filing that appeal is 21 days from receipt of the decision being appealed.

4.) Mr Plotniy and those other bodies that have a right of appeal under Article O of the Program may appeal against this decision, such appeal to be filed within 21 days of receipt of this decision.

5.) This decision is being sent to WADA and to RUSADA, and will be published on the ITF’s website.

WADA Prohibited List 2011

The 2011 Prohibited List International Standard : The World Anti-Doping Code / World Anti-Doping Agency (WADA). - Montreal : WADA, 2010.

- The official text of the Prohibited List shall be maintained by WADA and shall be published in English and French. In the event of any conflict between the English and French versions, the English version shall prevail.
- This List shall come into effect on 1 January 2011

In June 2010 the Agenţia Naţională Anti-Doping (ANAD), the National Anti-Doping Agency of Romania, has reported an anti-doping rule violation against the Athlete Domokos Balogh after his sample tested positive for the prohibited substance testosterone with a T/E ratio above the WADA threshold.
After notification a provisional suspension was ordered.
Research of the Athlete’s supplements showed that the food supplement Animal Test contained the prohibited substance testosterone.
On 16 September 2010 the ANAD Hearing Commission decides to impose a 2 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. 12 August 2010.

The French Basketball Federation (FFBB) has reported an anti-doping rule violation against the Player after his sample tested positive for the prohibited substance cannabis.
The FFBB decides a 4 month period of ineligibility. This decision is adopted by FIBA.

The Royal Dutch Motorcyclists Association (Koninklijke Nederlandse Motorrijders Vereniging, KNMV) has reported an anti doping rule violation against the Person after his A and B samples tested positive for the prohibited substance cannabis. After notification the Person filed a statement in his defence and he was heard for the KNMV Disciplinary Committee.

The Person denied that he had smoked cannabis and stated that he had stayed a long period with people smoking cannabis in a small unventilated environment. The Person argued that due to this passive smoking the cannabis came into his system and that the violation was not intentional.
Considering exceptional circumstances, the KNMV Disciplinary Committee decides on 15 September 2010 to impose a reprimand on the Person.

Fees and expenses shall be borne by the Person.

ISR 2010 KNMV Decision Disciplinary Committee 2010039 T

The Royal Dutch Motorcyclists Association (Koninklijke Nederlandse Motorrijders Vereniging, KNMV has reported an anti doping rule violation against this person after he tested positive for the prohibited substance benzoylecgonine (a metabolite of cocaine).
KNMV notified the person of the doping violation and ordered a provisional suspension. Person filed a statement in his defence and was heard for the Committee.

The Person admitted he had used cocaine at a party a few days prior to the doping control without intention to enhance his performance. Without mitigating circumstances the Disciplinary Committee decides on 15 September 2010 to impose a two year period of ineligibility starting on the date of the provisional suspension. Fees and expenses for this committee shall be borne by person.

In July 2009 the International Cycling Union (UCI) has reported an anti-doping rule violation against the Spanish cyclist M. after his A and B samples tested positive for the prohibited substance Erythropoietin (EPO).

On 30 April 2010 the RFEC decided to impose a 2 year period of ineligibility on the Athlete including a fine. Hereafter in June 2010 both the Athlete and the UCI appealed the RFEC decision with the Court of Arbitration for Sport (CAS).

In this partial award CAS assessed different issues raised by the parties. Thereupon the President of the Appeals Arbitration Division decides on 14 September 2010:

1.) The request to intervene in the procedure TAS 2010/A/2141 filed by the UCI is accepted.

2.) The procedures TAS 2010/A/2141 and TAS 2010/A/2142 are consolidated before a single arbitration panel.

3.) The manner of appointment of the two co-arbitrators will be determined according to the agreement between the parties
within a time period later to be decided by the CAS Court Office. Failing in this agreement within the time limit, the co-arbitrators will be appointed by the President of the Appeals Arbitration or his deputy.

4.) The President of the Arbitral Panel shall be appointed by the President of the Appeals Arbitration Division or his deputy.

5.) The time limit for the appeals remain suspended until further notice from the CAS Court Office.

6.) This decision is without costs.
