TED 2016_04 CNCD vs Felipe Sáez Cereceda

In November 2015 the National Doping Control Commission of Chile (CNCD) has reported an anti-doping rule violation against the karate Athlete Rodrigo Idro Ramírez after his sample tested positive for the prohibited substance Modafinil.

After notification a provisional suspension was ordered and the Athlete attended the hearing of the Disciplinary Panel of the Tribunal de Expertos en Dopaje (TED).

The Athlete denied the intentional use of the substance and explained how the substance entered his system. As a result the Panel accepts that the violation was not intentional.

The Disciplinary Panel finds that the presence of prohibited substances has been established in the Athlete's sample and accordingly that he committed an anti-doping rule violation.

Therefore the TED Disciplinary Panel decides on 6 April 2016 to impose a 2 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 13 November 2015.

TED 2016_05 CNCD vs Cristopher Guajardo Mondaca

In July 2015 the National Doping Control Commission of Chile (CNCD) has reported an anti-doping rule violation against the karate Athlete Cristopher Guajardo Mondaca after his sample tested positive for the prohibited substance Human Recombinant Erythropoietin (rhEPO).

After notification a provisional suspension was ordered and the Athlete filed a statement in his defence. Further the Athlete provided substantial assisstance to the CNCD regarding anti-doping rule violations committed by other athletes or other persons.

The Disciplinary Panel of the Tribunal de Expertos en Dopaje (TED) finds that the presence of the prohibited substance has been established in the Athlete's sample and accordingly that he committed an anti-doping rule violation. The Panel considers that the Athlete had provided substantial assistance regarding committed anti-doping rule violations.

Therefore the TED Disciplinary Panel decides on 27 May 2016 to impose a 2 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 22 July 2015.

TED 2016_06 CNCD vs Dario Andrés Ortiz Fuentes

In July 2016 the National Doping Control Commission of Chile (CNCD) has reported an anti-doping rule violation against the wheelchair basketball player Dario Andrés Ortiz Fuentes after his sample tested positive for the prohibited substance Cannabis in a concentration above the WADA threshold.

After notification a provisional suspension was ordered. The Parathlete filed a statement in his defence and he was heard for the Disciplinary Panel of the Tribunal de Expertos en Dopaje (TED).

The Parathlete accepted the test result and admitted the violation. He denied the intentional use of the substance and explained that he had used Cannabis as treatment for the severe pain he suffered due to his paraplegia.

The Panel finds that the presence of the prohibited substance has been established in the Athlete's sample and accordingly that he committed an anti-doping rule violation. The Panel accepts that the violation was not intentional and considers that it occurred out-of-competition.

Therefore the TED Disciplinary Panel decides on 14 November 2016 to impose a 6 month period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 29 July 2016.

TED 2016_07 CNCD vs Juan Guillermo Medina Muñoz

In May 2016 the National Doping Control Commission of Chile (CNCD) has reported an anti-doping rule violation against the Athlete Juan Guillermo Medina Muñoz after his A and B samples tested positive for the prohibited substances Mesterolone, Methyltestosterone and Stanozolol.

After notification a provisional suspension was ordered. The Athlete filed a statement in his defence and he was heard for the Disciplinary Panel of the Tribunal de Expertos en Dopaje (TED).

The Athlete denied the intentional use of the substances and explained with medical evidence that he had used prescribed medications as treatment for his low testosterone levels.

The Panel finds that the presence of the prohibited substances has been established in the Athlete's samples and accordingly that he committed an anti-doping rule violation.

The Panel established that the medications Proviron (Mesterolone) and Nolvadex (Tamoxifen) were prescribed for the Athlete's treatment. However the Panel holds that Tamoxifen is unavailable in Chile and the presence of this substance was not detected in his samples. The Athlete's application for a TUE was denied.

Further the Panel considers that the prescribed medications could not explain the presence of the prohibited substances Stanozolol and Methyltestosterone in his samples.

Therefore the TED Disciplinary Panel decides on 6 October 2016 to impose a 4 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 6 May 2016.

TED 2016_10 CNCD vs Carlos Aranda Zapata

In September 2016 the National Doping Control Commission of Chile (CNCD) has reported an anti-doping rule violation against the basketball player Carlos Aranda Zapata after his sample tested positive for the prohibited substance Cannabis.

After notification a provisional suspension was ordered. The Athlete filed a statement in his defence and waived his right to be heard for the Disciplinary Panel of the Tribunal de Expertos en Dopaje (TED).

The Athlete accepted the test result, admitted the violation and denied the intentional use of the substance. He submitted that the Cannabis had been used recreationally in a context unrelated to sport performance whereas he was unaware that he had used a prohibited substance.

The Panel finds that the presence of the prohibited substance has been established in the Athlete's sample and accordingly that he committed an anti-doping rule violation. The Panel considers that the violation was not intentional and that it occurred out-of-competition.

Therefore the TED Disciplinary Panel decides on 10 November 2016 to impose a 6 month period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 30 September 2016.

TED 2016_13 CNCD vs Franco Araniba Perez

In November 2013 the National Doping Control Commission of Chile (CNCD) has reported an anti-doping rule violation against the weightlifter Francisco Moreno Cornejo after his sample tested positive for the prohibited substance Metandienone.

After notification a provisional suspension was ordered. The Athlete failed to respond to the CNCD communications, nor attended the hearing of the Disciplinary Panel of the Tribunal de Expertos en Dopaje (TED).

Therefore the TED Disciplinary Panel decides on 24 October 2016 to impose a 2 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 4 November 2013.

TED 2017_02 CNCD vs Manuel Miranda Varga

Therefore the TED Disciplinary Panel decides on 31 January 2017 to impose a 4 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 26 May 2016.

After notification a provisional suspension was ordered whereas the Athlete failed to attended the hearing of the Disciplinary Panel of the Tribunal de Expertos en Dopaje (TED).

Therefore the TED Disciplinary Panel decides on 31 January 2017 to impose a 4 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 26 May 2016.

TED 2017_04 CNCD vs Iván López Bilbao

In May 2016 the National Doping Control Commission of Chile (CNCD) has reported an anti-doping rule violation against the Athlete Iván López Bilbao after his A and B samples tested positive for the prohibited substance Methoxy polyethylene glycol-epoetin beta (CERA).

After notification a provisional suspension was ordered. The Athlete filed a statement in his defence and he attended the hearing of the Disciplinary Panel of the Tribunal de Expertos en Dopaje (TED).

The Athlete disputed the validity of the test results and asserted that because of departures of the ISL the charge against him must be dismissed. Yet, the Panel deemed that there had been no departures of the ISL that could invalidate the test results and rejected the Athlete's assertion in this matter.

As a result the Panel finds that the presence of the prohibited substance has been established in the Athlete's samples and accordingly that he committed an anti-doping rule violation.

Therefore the TED Disciplinary Panel decides on 31 January 2017 to impose 4 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 31 May 2016.

TED 2017_05 CNCD vs Mauricio Andrés Valdivia Verdugo

In May 2016 the National Doping Control Commission of Chile (CNCD) has reported an anti-doping rule violation against the Athlete Mauricio Andrés Valdivia Verdugo after his sample tested positive for the prohibited substance Methoxy polyethylene glycol-epoetin beta (CERA).

After notification a provisional suspension was ordered. The Athlete filed a statement in his defence and he attended the hearing of the Disciplinary Panel of the Tribunal de Expertos en Dopaje (TED).

The Athlete fully admitted the intentional use of the prohibited substance. In addition he provided to the CNCD evidence about potential anti-doping rule violations committed by other athlete's and their entourage.

The Disciplinary Panel finds that the presence of a prohibited substance has been established in the Athlete's sample and accordingly that he committed an anti-doping rule violation. The Panel deems that WADA can consider whether the Athlete with his evidence has provided substantial assistance for a reduced sanction.

Therefore the TED Disciplinary Panel decides on 31 January 2017 to impose a 4 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 26 May 2016.
