ADAK 2023 ADAK vs Zenah Jemutai Yego

In March 2023 the Anti-Doping Agency of Kenya (ADAK) reported an anti-doping rule violation against the Athlete Zenah Jemutai Yego after her sample tested positive for the prohibited substance Triamcinolone acetonide.

Following notification the Athlete gave a prompt admission, waived her right for a hearing and accepted in this settlement the sanction proposed by ADAK. In this case ADAK establised that the Athlete's violation was not intentional and the result of Legitimate Medical Treatment.

Therefore on 7 September 2023 ADAK decides to impose a 1 year period of ineligibility on the Athlete, starting on 27 March 2023.

ADAK 2023 ADAK vs Agnes Mumbua

In May 2023 the Anti-Doping Agency of Kenya (ADAK) reported an anti-doping rule violation against the Athlete Agnes Mumbua after her sample tested positive for the prohibited substance Methasterone.

Following notification a provisional suspension was ordered. The Athlete filed a statement in her defence and she was heard for the Kenya Sports Disputes Tribunal.

The Athlete denied the intentional use of the substance and requested the Panel for a reduced sanction. She explained that she underwent medical treatment for her condition whereas she had used medication and received injections.

The Panel finds that the presence of a prohibited substance has been established in the Athlete's sample and accordingly that she committed an anti-doping rule violation.

The Panel determines that the Athlete failed to demonstrate with any corroborating evidence that she underwent medical treatment for her alleged condition, neither that the violation was not intentional. Further the Panel considers that there had been substantial delays in the proceedings not attributed to the Athlete.

Therefore the Panel decides on 12 October 2023 to impose a 4 year period of ineligibility on the Athlete, starting on the date of the sample collection, i.e. on 27 February 2022.

ADAK 2023 ADAK vs Eliud Kibet Too

In March 2023 the Anti-Doping Agency of Kenya (ADAK) reported an anti-doping rule violation against the Athlete Eliud Kibet Too after his sample tested positive for the prohibited substances 19-norandrosterone and 19-noretiocholanolone (Nandrolone).

Following notification a provisional suspension was ordered. In this case the Athlete failed to respond to ADAK's communications, nor cooperated with the proceedings.

Further the Athlete failed to attend the hearings of the Kenya Sports Disputes Tribunal. Hence the Tribunal rendered a decision based on the written submissions of the Parties.

The Panel finds that the presence of the prohibited substance Nandrolone had been established in the Athlete's sample and accordingly that he committed an anti-doping rule violation.

The Panel determines that Athlete didn't provide any explanation in his defence. Moreover he failed to respond at all and evaded cooperation with the proceedings.

Ultimately the Panel concludes that the Athlete failed to demonstrate that the violation was not intentional. He also did not explain how the substances had entered his system.

Therefore the Tribunal decides on 14 September 2023 to impose a 4 year period of ineligibility on the Athlete, starting on the date of this decision.

CCES 2023 CCES vs David Mylnikov

In July 2023 the Canadian Centre for Ethics in Sport (CCES) reported an anti-doping rule violation against the Athlete David Mylnikov after his sample tested positive for the prohibited substance Cannabis in a concentration above the WADA threshold.

Following notification the Athlete gave a promp admission, accepted the sanction proposed by CCES and signed a Waiver of Hearing. CCES accepted that the Athlete's use of Cannabis occurred out-of-competition in a context unrelated to sport performance.

Therefore CCES decides on 2  November 2023 to impose a 3 month period of ineligibility on the Athlete, starting on 11 October 2023.

UKAD 2023 RFU vs Arran Lee Perry

September 10, 2020

On 10 September 2020 the Rugby Football Union (RFU) decided to impose a 4 year period of ineligibility on the rugby player Arran Lee Perry after he tested positive for the prohibited substance Oxandrolone.

Hereafter in February 2023 the RFU reported that the Athlete had breached his period of ineligibiltiy. Its investigation had established that he had participated in a training session in November 2022.

Following notification the Athlete acknowledged that he only participated into this training with friends and family while it was not organised by his club.

In this matter the RFU considers the Athlete's conduct and his degree of fault. The RFU concludes that there are sufficient grounds for the imposition of a reduced addition sanction on the Athlete.

Therefore the RFU decides on 10 September 2020 to impose an additional 6 month period of ineligibility on the Athlete, starting on the date the current sanction shall end, i.e. on 20 December 2023.

World Athletics 2022 WA vs Nzubechi Grace Nwokocha

On 21 August 2022 the Commonwealth Games Federation (CGF) reported an anti-doping rule violation against the Nigerian Athlete Grace Nwokocha after she tested positive for the prohibited substances Enobosarm (ostarine) and LGD-4033 (ligandrol).

Consequently the CFF Court decided on 17 May 2023 that the Athlete had committed an anti-doping rule violation. Furthermore the results obtained by the Athlete and her team at the 2022 Commonwealth Games were disqualified.

Hereafter the case was referred to the Athletics Integrity Unit (AIU), on behalf of World Athletics, for determination of consequences. Previously in September 2022 a provisional suspension already had been ordered by the AIU.

Thereupon in July 2023 the Athlete and World Athlettics entered into a Case Resolution Agreement. The Athlete admitted the violation and accepted the sanction proposed by the AIU.

Therefore on 27 October 2023 the Parties agree that a sanction of 3 years is imposed on the Athlete, starting on the date of the sample collection, i.e. on 3 August 2022.

ADAK 2023 ADAK vs Benard Cheruiyot Chepkwony

In January 2023 the Anti-Doping Agency of Kenya (ADAK) reported an anti-doping rule violation against the Athlete Benard Cheruiyot Chepkwony after his sample tested positive for the prohibited substance Triamcinolone acetonide.

Following notification a provisional suspension was ordered. Thereupon in June 2023 the Athlete was heard for the Kenya Sports Disputes Tribunal.

The Athlete explained that he suffered from a condition and that he attended a chemist where he had received an injection. Further he alleged that he could not read and that his phone malfunctioned in receiving e-mails.

He asserted that he was not timely notified about the positive test, nor informed about the analysis of his B sample. However he acknowledged that he had received the Notice of Charge in January 2023. Prior he had received some anti-doping education

The Panel determines that in January 2023 the Athlete had been duly notified by ADAK about his positive test and thus informed about his right to request analysis of his B sample. Despite the Athlete's allegations the Panel concludes that there had been no departures of the ISTI, the WADC or the ADAK ADR.

The Panel finds that the presence of a prohibited substance has been established in the Athlete's sample and accordingly that he committed an anti-doping rule violation.

The Panel deems that there was insufficient evidence to conclude that the Athlete's violation was not intentional. Yet, the Panel considers that there are no grounds for No Significant Fault or Negligence.

Therefore the Panel decides on 7 September 2023 to impose a 2 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 13 February 2023.

World Athletics 2023 WA vs Daisy Cherotich

In February 2023 the Athletics Integrity Unit (AIU), on behalf of World Athletics, reported an anti-doping rule violation against the Kenyan Athlete Daisy Cherotich after her sample tested positive for the prohibited substance recombinant Erythropoietin (rhEPO).

Following notification a provisional suspension was ordered. Initially the Athlete failed to respond to the AIU communications. Ultimately in July 2023 the Athlete timely admitted the violation, waived her right for a hearing and accepted the sanction proposed by the AIU.

The AIU deems that the Athlete failed to demonstrate that the violation was not intentional. Because she had signed and submitted the Admission of Anti-Doping Rule Violations and Acceptance of Consequences Form she received a 1 year reduction from the AIU.

Therefore the AIU decides on 19 October 2023 to impose a 3 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 21 February 2023.

World Athletics 2023 WA vs Xin Zhang

In April 2023 the Athletics Integrity Unit (AIU), on behalf of World Athletics, reported an anti-doping rule violation against the Chinese Athlete Xin Zhang after her sample tested positive for the prohibited substance Metandienone. Following notification a provisional suspension was ordered and the Athlete filed a statement in her defence.

The Athlete explained that in March 2023 she had attended a group training run and that there had been een mix up of drink bottles. The drink bottle she had prepared for was similar to the drink bottle prepared by others.

The Athlete had contacted the participants who had attended the group training run. She claimed that a Training Partner had added Dianabol (Metandienone) into his bottle to improve muscle strength.

AIU requested assistance from the China Anti-Doping Agency (CHINADA) with an investigation into the Athlete's explanation. CHINADA's investigation confirmed that the Training Partner had admitted the use of Methandienone in his drink bottle. Besides he had also purchased and used other banned substances.

The AIU concludes that the Athlete had committed an anti-doping rule violation and that she failed to demonstrate that the violation was not intentional. Thereupon in September 2023 the AIU submitted a Notice of Charge to the Athlete and an Admission of Anti-Doping Rule Violations and Acceptance of Consequences Form.

Hereafter the Athlete gave a timely admission, waived her right for a hearing and accepted the sanction proposed by the AIU. Because she had signed and submitted the Acceptance of Consequences Form she received a 1 year reduction from the AIU.

Therefore the AIU decides on 18 October 2023 to impose a 3 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 21 April 2023.

World Athletics 2022 WA vs Jennifer Gonzalez Caro

On 7 November 2022 the National Doping Control Commission of Chile (CNCD) reported an anti-doping rule violation against the Chile Athlete Jennifer Gonzalez Caro after her sample - provided in Chile in May 2022 - tested positive for the prohibited substance Recombinant Erythropoietin (rhEPO).

On 10 November 2022 the South American Sports Organization (ODESUR) reported also an anti-doping rule violation against the Athlete after her sample - provided in Paraguay in October 2022 - tested positive for rhEPO.

Consequently ODESUR ruled on 30 March 2023 that the Athlete had committed an anti-doping rule violation and disqualified her results obtained at the South American Games in Paraguay. Thereupon the case was referred to World Athletics to initiate further proceedings.

Thereupon on 16 May 2023 the Tribunal Expertos En Dopaje Chile (TED) decided to impose a sanction of 4 years on the Athlete for the presence of rhEPO in her sample she provided in Chile in May 2022.

Hereafter in September 2022 the Athletics Integrity Unit (AIU), on behalf of World Athletics, reported multiple anti-doping rule violation against the Athlete based on the Decisions rendered by TED and ODESUR.

Following notification the Athlete failed to respond to the AIU communications within the set deadline. Consequently the AIU determines that the Athlete was deemed to have waived her right for a hearing and accepted the consequences.

Further the AIU considers that there are aggravating circumstances present in this case because the Athlete had used rhEPO on multiple occasions over at least 5 months. These violations justify the imposition of a more sever sanction.

Therefore the AIU decides on 16 October 2023 to impose a 6 year period of ineligibility on the Athlete, starting on the date of the provisional suspension ordered in Chile, i.e on 7 November 2022.
