In September 2012 the Japan Anti-Doping Agency (JADA) has reported an anti-doping rule violation against the Athlete J-4135 (the Athlete) after his sample tested positive for the prohibited substance furosemide. After notification a provisional suspension was ordered. The Athlete filed a statement in his defence and he was heard for the Japan Anti-Doping Disciplinary Panel.

The Athlete stated that he has used a herbal medication purchased on the internet as treatment for his insomnia.
Considering the Athlete's negligence and his statement the Japan Anti-Doping Disciplinary Panel has his doubts that the use was non intentional and decides on 28 September 2012 to impose a 2 year period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. on 18 September 2012.

SAIDS 2011_23 SAIDS vs Enzo Lezzi

In January 2012 the South African Institute for Drug-Free Sport (SAIDS) has reported an anti-doping rule violation against the Athlete Enzo Lezzi after his sample tested positive for the prohibited substance 19-norandrosterone, metabolite of nandrolone. After notification a provisional suspension was ordered. The Athelete filed a statement in his defence and was heard for the SAIDS Disciplinary Committee.

The 48 years old amateur cyclist admitted the violation and stated that he suffered from an injury relating to arthritis in the knees. Therefore the prescribed substance Deca Durabolin was administered out of season through double injections in both knee joint by his sister, an apaediatrician. The Athlete’s statement was sustained by his medical file presented to the Committee.

Considering the circumstances in this case the Committee finds that the Athlete bears no significant fault or negligence. Therefore the SAIDS Discliplinary Committee decideds to impose a 15 month period of inelgilibility on the Athlete, starting on the date of the notification, i.e. on 21 November 2011.

Affidavit Renzo Ferrante [USADA vs Lance Armstrong October 10, 2012] September 27, 2012

Mr. Renzo Ferrante is a member of the Italian Carabinieri NAS law enforcement agency. Mr. Ferrante stated to USADA that in the course of their investigation of Dr. Ferrari they have obtained bank records relating to payments made by athletes and others to Dr. Ferrari and his son Stefano Ferrari. Also they have obtained electronic mails between athletes and athletes support personnel, including Lance Armstrong, Johan Bruyneel and others to Dr. Ferrari and to entities controlled by Dr. Ferrari and his son Stefano Ferrari.
In addition they have obtained evidence and witness statements provided by professional cyclist against Dr. Ferrari.

The World Anti-Doping Agency (WADA) has been admitted by the Italian prosecutor and has been given access to the casefile in order to review and obtain documents and information related to Dr. Ferrari, including his clients and relatives, and others involved in potential violation of sport antidoping rules.

AFLD 2012 FFHMFAC vs Respondent M76

The French Federation of Weightlifting, Fitness, Powerlifting and Bodybuilding (Fédération Française d'Halterophilie, Musculation, Force Athlétique et Culturisme, FFHMFAC) charges M76 for a violation of the Anti-Doping Rules. During a pose-down contest on February 8, 2012, a sample was taken for doping test purposes. The analysis of the sample showed the presence of: clenbuterol, 3 metabolites of stanozolol, a metabolite of drostanolone and a metabolite of nandrolone. All of these substances are prohibited according the World Anti-Doping Agency (WADA) prohibited list.

During a weightlifting match on January 8, 2012, a sample was taken for doping purposes. The analysis of the sample showed the prensence of norandosterone, a metabolite of drostanolone, metandienone, methyltestosterone and a abnormal high ratio of testosterone and epitestorterone measured with a spectrometric analysis of the isotopes involved. All of theses substances are prohibited by the World Anti-Doping Agency (WADA) prohibited list.

The French Wrestling Federation (Fédération Française de Lutte, FFL) charges respondent M73 for a violaton of the Anti-Doping Rules. During a match on November 19, 2011, a sample was taken for doping control purposes. The analysis of the sample showed the presence of prednisolone and prednisone. Prednisolone and prednisone are prohibited substances according the World Anti-Doping Agency (WADA) prohibited list and regarded as specified substances.

History
The respondent claimed he used medication or therapeutic purposes
to treat asthma. He has a certificate of his physician and some medical investigations.

Decision

The French Athletics Federation (Fédération Française d'Athlétisme,FFA) charges respondent M72 for a violation of the Anti-Doping Rules. During a athletics event on November 27, 2011, a sample for doping test purposes was taken. The sample tested positive on a metabolite of cannabis. Cannabis is a prohibited substance according the World Anti-Doping Agency (WADA) prohibited list and is regarded as a specified substance.

History
The respondent didn't want to improve athletic performance and claimed that the occasional use of this substance was because of difficult personal circumstances.

Decision.
1. The sanction is a period of ineligibility of six months in which the respondent can't take part in competition or manifestations organized or authorized by the FFA.
2. The period of ineligibility will be reduce by the period already served by the sanction of May 3, 2012, by the disciplinary committee of the FFA.
3. The decision (period ineligibility of three months) of May 3, 2012, by disciplinary committee of the FFA will be modified.
4. The decision will be published and sent to the parties involved.
