In January 2013 the Japan Anti-Doping Agency (JADA) has reported an anti-doping rule violation against the Athlete J-4140 (the Athlete) after he refused and failed to submit to sample collection.
After notification a provisional suspension was ordered. The Athlete filed a statement in his defence and he was heard for the Japan Anti-Doping Disciplinary Panel.
The Korean Athlete is since September 2011 residing in Japan, working as a coach and able to speak the Japanes language basically but he can’t read Japanese written documents. The Athlete was selected in February 2013 at a Taekwondo competition in Japan to provide a sample for drug testing. Initially the Athlete cooperated but he failed to produce a sample in the presence of the Doping Control Officer. Due to the delays and a return flight he had to catch the Athlete decided not to complete the sample collection and he left the Doping Control Station in spite of the warnings of the Doping Control Officer.
The Athlete stated that during the sample collection and due to the delays at the Doping Control Station he followed the advice of the chairperson of his Taekwondo Association who told him to leave without completing the sample collection. The Athlete asserted that he had misunderstood the implications of his violation because he expected only to be excluded for competitions but instead he was completely suspended including for his work as a coach.
Without grounds that justify his violation the Japan Anti-Doping Disciplinary Panel decides on 14 May 2013 to impose a 2 year period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. on 7 April 2013.
