JADDP 2015-009 JADA vs J-4079

In November 2015 the Japan Anti-Doping Agency (JADA) has reported an anti-doping rule violation against the Athlete J-4079 (the Athlete) after his sample tested positive for the prohibited substance oxilofrine. After notification a provisional suspension was ordered. The Athlete filed a statement in his defence and he was heard for the Japan Anti-Doping Disciplinary Panel.

The Athlete denied the intentional use of doping and stated that he had purchased on the internet the supplement SP250. He had researched the ingredients of the product before using and he mentioned the use of the supplement on the Doping Control Form. The Athlete assumed that the supplement was safe because the sales and import agency of the supplement manufacturer was an official sponsor of the Japan Bodybuilding & Fitness Federation (JBBF) and one of the directors of the agency was connected to the JBBF and the Japan Olympic Committee (JOC).

The Panel finds that such supplements have a warning label and the Athlete was already informed by his Sports Federation about the risks with supplements purchased on the internet. Also the information on the internet about the supplement - provided by the sales and import agency as connected to the JBBF and JOC - is not a guarantee that these supplements don’t contain a prohibited substance.
The Athlete argued that these warning labels were not applied on the supplements he used in the past.

Considering the circumstances the Japan Anti-Doping Disciplinary Panel decides on 16 March 2016 to impose a 2 year period of ineligibility on the Athlete starting on the date of the provisional suspension i.e. on 5 November 2015.

JADDP 2015-008 JADA vs J-4078

In November 2015 the Japan Anti-Doping Agency (JADA) has reported an anti-doping rule violation against the Athlete J-4078 (the Athlete) after his sample tested positive for the prohibited substance metandienone. After notification a provisional suspension was ordered. The Athlete filed a statement in his defence and he was heard for the Japan Anti-Doping Disciplinary Panel.

The Athlete admitted the violation and stated that he had purchased Dianabol (metandienone) on the internet which he used before and after training several times a week.

Considering the intention to enhance sport performance the Japan Anti-Doping Disciplinary Panel decides on 7 January 2016 to impose a 4 year period of ineligibility on the Athlete starting on the date of the provisional suspension i.e. on 2 November 2015.

JADDP 2015-007 JADA vs J-4077

In November 2015 the Japan Anti-Doping Agency (JADA) has reported an anti-doping rule violation against the Athlete J-4077 (the Athlete) after his sample tested positive for the prohibited substance oxilofrine. After notification a provisional suspension was ordered. The Athlete filed a statement in his defence and he was heard for the Japan Anti-Doping Disciplinary Panel.

The Athlete denied the intentional use of doping and stated that he had purchased on the internet a supplement SP250 and researched the ingredients of the product before using. The Athlete asserted that the supplement manufacturer was formally accredited by the Japan Bodybuilding & Fintness Federation.
The Panel finds that such supplements clearly have a warning label and the Athlete was already informed by his Sports Federation about the risks with supplements purchased on the internet.

Considering the circumstances the Japan Anti-Doping Disciplinary Panel decides on 8 December 2015 to impose a 2 year period of ineligibility on the Athlete starting on the date of the provisional suspension i.e. on 2 November 2015.

JADA 2015-006 JADA vs J-4076

In December 2015 the Japan Anti-Doping Agency (JADA) has reported an anti-doping rule violation against the Athlete J-4076 (the Athlete) for three whereabouts filing failures to submit accurate and complete whereabouts information (1st, 3rd and 4th quarter of 2015) within a 12 month period.

After notification the Athlete admitted the violation, waived his right to be heard and filed no statement in his defence.
Considering the Athlete was sanctioned before on 19 September 2013 for the use of clenbuterol JADA decides on 4 March 2016 to impose a 4 year period of ineligibility on the Athlete as second violation starting on the date of the provisional suspension i.e. on 4 December 2015.

JADDP 2015-005 JADA vs J-4075

In October 2015 the Japan Anti-Doping Agency (JADA) has reported an anti-doping rule violation against the Athlete J-4075 (the Athlete) after his sample tested positive for the prohibited substance methylephedrine. After notification a provisional suspension was ordered.

In his defence the Athlete stated that he purchased in a drugstore an over the counter cold medication because of his illness during the training camp period prior to the competition.

The Panel accepts the Athlete’s statement and finds that the foreign Athlete acted with a certain degree of negligence because the Athlete used the medication without noticing that the label of the medication mentioned in Japanese that it contained methylephedrine. The Panel considers that the Athlete had limited understanding of the Japanese language and purchased the cold medication recommended by the salesman after he had indicaded that he was an Athlete and wanted a doping-free cold medication.

With No Significant Negligence the Japan Anti-Doping Disciplinary Panel decides on 17 November 2015 to impose a 8 month period of ineligibility on the Athlete starting on the date of the provisional suspension i.e. on 6 October 2015.

JADDP 2015-004 JADA vs J-4074

In August 2015 Japan Anti-Doping Agency (JADA) has reported an anti-doping rule violation against the Athlete J-4074 (the Athlete) after his sample tested positive for the prohibited substance dehydrochlormethyltestosterone. After notification a provisional suspension was ordered.

The Athlete stated that the violation was non intentional but the Panel concludes that the Athlete failed to explain how the substance came into his body and he had igonored the warnings on the labels of the supplements he used.

Considering that the Athlete was sanctioned before in November 2013 for the use of clenbuterol the Japan Anti-Doping Disciplinary Panel decides on 27 October 2015 to impose an 8 year period of ineligibility on the Athlete as second violation starting on the date of the provisional suspension, i.e. on 21 August 2015.

JADDP 2015-002 JADA vs J-4073

In July 2015 the Japan Anti-Doping Agency (JADA) has reported an anti-doping rule violation against the Athlete J-4073 (the Athlete) after his A and B samples tested positive for the prohibited substance drostanolone. After notification a provisional suspension was ordered. The Athlete filed a statement in his defence and he was heard for the Japan Anti-Doping Disciplinary Panel.

The Athlete had purchased supplements on the internet and used to enhance his concentration for several months. He stated that the violation was non intentional and that one of his supplements contained the prohibited substance without his knowledge.

The Panel concludes that the Athlete failed to explain how the substance came into his body and took a risk with the use of supplements purchased on the internet while he was informed by his federation about the dangers of prohibited substances in these supplements.

Therefore the Japan Anti-Doping Disciplinary Panel rejects the Athlete’s statement en decides on 12 November 2015 to impose a 4 year period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. on 30 July 2015.

JADDP 2015-001 JADA vs J-4072

In July 2015 the Japan Anti-Doping Agency (JADA) has reported an anti-doping rule violation against the American softball Athlete J-4072 (the Athlete) after her A and B samples tested positive for the prohibited substances oxilofrine (methylsynephrine) and phenethylamine. After notification a provisional suspension was ordered. The Athlete filed a statement in her defence and was heard for the Japan Anti-Doping Disciplinary Panel.

The Athlete stated that she had used a contaminated supplement Dexaprine XR and that she had researched the ingredients of the product before using. Without intention to enhance her performance the Athlete requested for a reduced sanction.

The Panel finds it sufficiently possible that an “official” website of the manufacturer of these supplements is not a reliable source to obtain confirmation about the safety of supplements. Therefore the Athlete should have confirmed saftety with careful consideration of such risks as well. The Panel considers that the American Athlete received in Japan relevant anti-doping information about the contamination risks in supplements only in the Japanese language although previously in the US softball team she had received this information in the English language.

With No Significant Fault or Negligence the Japan Anti-Doping Disciplinary Panel accepts that the Athlete’s violation was non intentional and decides on 8 December 2015 to impose a 8 month period of ineligibility starting on the date of the provisional suspension, i.e. on 7 July 2015.

JADDP 2014-009 JADA vs J-4071

In March 2015 the Japan Anti-Doping Agency (JADA) has reported an anti-doping rule violation against the Athlete J-4071 (the Athlete) after his sample tested positive for the prohibited substance tulobuterol. After notification a provisional suspension was ordered and the Athlete filed a statement in his defence.

The Athlete submitted that he suffered from asthma and used the prescribed medication Hokunalin with a TUE and without intention to enhance his sport performance. The Panel finds that the Athlete’s doctor had no special knowledge about anti-doping rules and prohibited substances and the Athlete assumed that the prescribed medication did not contain prohibited substances, also because it is not an oral medication.

Considering the circumstances in this case the Japan Anti-Doping Disciplinary Panel decides on 21 April 2015 to impose a 3 month period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. on 25 March 2015.

JADDP 2014-008 JADA vs J-4070

In January 2015 the Japan Anti-Doping Agency (JADA) has reported an anti-doping rule violation against the Athlete J-4070 (the Athlete) after her sample tested positive for the prohibited substance tulobuterol. After notification a provisional suspension was ordered and the Athlete filed a statement in her defence.

The Athlete submitted, sustained by her doctor and medical record, that she suffered from asthma bronchitis and cough and had used prescribed Hokunalin medication as treatment without intention to enhance her sport performance.
The Panel concludes that the Athlete was negligent due to she failed to check the ingredients of the medication before using and also finds that the Athlete’s doctor had insufficient knowledge about anti-doping rules and prohibited substances in Volleyball.

Considering the circumstances in this case the Japan Anti-Doping Disciplinary Panel decides on 18 February 2015 to impose a 2 month period of ineligibility on the Athlete starting on the date of the provisional suspension, i.e. on 7 January 2015.
