AFLD 2015 FFM vs Respondent M34

Facts
The French Motorcycling Federation (Fédération Française de Motocyclisme, FFM) charges respondent M34 for a violation of the Anti-Doping Rules. During a motorcycling event on June 22, 2014, the respondent provided a sample for doping test purposes. Analysis of the sample showed the presence of prednisolone and prednisone, these are prohibited substances according the World Anti-Doping Agency (WADA) 2014 prohibited list. They are regarded as specified substances.

History
The respondent had used the remnants of medication he took for treating breathing problems from which he suffers several years. He has the prescription dated December 14, 2012. He had been negligent for checking the ingredients but claims the physician had not informed him that it contained a prohibited substance which is not allowed during competition.
The panel regard this self medication as dangerous act, also the concentration measured and the explanation will result in a sanction.

Decision
1. The decision is a period of ineligibility of three months in which respondent can't take part in competition and manifestation of the FFM.
2. All his results obtained on June 22, 2014, will be cancelled. Medals, points and prizes will be withdrawn.
3. The present decision will start on the date of notification.
4. The decision will be published and sent to the parties involved.

AFLD 2015 FFC vs Respondent M33

The French Cycling Federation (Fédération Française de Cyclisme, FFC) charges respondent M33 for a violation of the Anti-Doping Rules. During a cycling event on November 23, 2014, respondent provided a sample for doping test purposes. Analysis of the sample showed the presence of prednisone and prednisolone which are prohibited substances according the World Anti-Doping Agency (WADA) 2014 prohibited list. They are regarded as specified substances.

History
The council of French Anti-Doping Agency (AFLD) had sentenced the respondent in the past with a period of ineligibility of two years in her decision of May 15, 2008.
The respondent claims he had used medication from his wife containing prednisolone which caused the positive test. He had used it for treatment of his hurt knee.
The panel regards auto medication as a dangerous and wrong act.

Decision
1. The sanction is a period of ineligibility of three years in which respondent can not take part in competition or manifestations organized or authorized by the FFC or related French sport federations.
2. All the results obtained on November 23, 2014, are cancelled. Medals, points and prizes are withdrawn.
3. The decision starts on the date of the notification.
4. The decision will be published and sent to the parties involved.

They are regarded as specified substances.

History
The disciplinary committee of the FCC had sanctioned the respondent with a period of ineligibility of four months in which he can not take part in competition or manifestations organized or authorized by the FCC. All his results obtained on November 23, 2014, are cancelled. Medals, points en prizes are withdrawn.
The respondent had used medication containing prednisolone which metabolizes in the body into prednisone. It was used for therapeutic reasons to treat treat laryngitis and bronchitis. His medical file proves his condition.
Given the circumstances of the case and the transmitted medical documentation the panel considers his treatment as justifiable.

1. The respondent receives a warning.
2. The decision starts on the date of the notification.
3. The decision of the disciplinary committee will be modified.
4. The decision will be published and sent to the parties involved.

During a cycling event on October 12, 2014, respondent delivered a sample for doping test purposes. Analysis of the sample showed the presence of prednisone and prednisolone which are prohibited substances according the World Anti-Doping Agency (WADA) 2014 prohibited list. They are regarded as specified substances.

History
The respondent had used medication containing prednisolone wich metabolizes in the body into prednisone. It was used for therapeutic reasons for a oncology treatment of his thorax. He had medical statements to prove his condition and medication. The measured concentration of the prohibited substance was in accordance with the doses on his prescription.

Decision
1. The respondent is acquitted.
2. The decision will be published and sent to the parties involved.

Facts
The French Cycling Federation (Fédération Française de Cyclisme, FFC) charges respondent M30 for a violation of the Anti-Doping Rules. During a cycling event November 23, 2014, respondent was required for delivering a sample for doping test purposes. Respondent was unable to deliver enough urine for a valid test.

History
The respondent had been sanctioned by the disciplinary committee of the FFC with a period of ineligibility of three months in which he is not allowed to take part in competition and manifestations organized or authorized by the FFC. His results obtained on November 23, 2014, were annulled. Medals, points and prizes were withdrawn.

Decision
1. The sanction is a period of ineligibility of nine months in which respondent can't take part in competition or manifestations organized or authorized by the FFC and related sport federations.
2. The period of ineligibility will be reduced with the period already served under the sanction of the disciplinary committee of the FFC.
3. The decision of the disciplinary committee needs to be modified.
4. The decision starts on the date of notification.
5. The decision will be published and sent to the parties involved.
