NZRU 2014 DFSNZ vs Finn Hart-Strawbridge

Facts
Drug Free Sport New Zealand (DFSNZ) alleged Finn Hart-Strawbridge, the athlete, for a violation of the Anti-Doping Rules. The proceedings are based on the Athlete having ordered a prohibited substance “GHRP-6” over the internet in September 2014.

History
The athlete admitted the violation. He claims to have ordered it as a joke, customs had intercepted the package.
The panel concludes that the athlete had put himself at risk with his action; he acted naive about the outcome.

Decision
- The sanction is a period of ineligibility of two years, from and including 23 September 2014.

AFLD 2015 FFBB vs Respondent M39

Facts
The French Basketball Federation (Fédération Française de Basket-Ball, FFBB) charges respondent M39 for a violation of the Anti-Doping Rules. During a match on November 8, 2014, a sample was taken for doping test purposes. The analysis of the sample showed the presence of morphine which is a prohibited substance according the World Anti-Doping Agency (WADA) 2014 prohibited list. It is regarded as a specified substance.

History
The respondent had used medication containing codethyline which metabolizes into morphine. He had used it to treat a soar throat. He has a copy of the invoice which mentions the medication in the form of a syrup. He did not had the intention to enhance his sport performance.
The panel agrees that the measured concentration is in accordance with the medical use.

Decision
1. The respondent is acquitted.
2. The decision will be published and sent to the parties involved.

AFLD 2015 FFA vs Respondent M38

Facts
The French Athletics Federation (Fédération Française d'Athlétisme, FFA) charges respondent M38 for a violation of the Anti-Doping Rules.
Respondent provided a sample for doping control purposes on December 21, 2014, during a test run. Analysis of the samples showed the presence of tuaminoheptane which is a prohibited substance according the World Anti-Doping Agency (WADA) 2015 prohibited list. It is regarded as a specified substance. She has a prescription for the medicine.

History
The respondent had been sanctioned by the disciplinary committee of the FFA with a period of ineligibility of 9 months in which respondent could not take part in competition or manifestations organized or authorized by the FFA. Results obtained on December 21, 2014, were cancelled. Medals, point and prizes were withdrawn.
The respondent had used medication against nasopharyngitis from which she suffered for several weeks and wanted to avoid contamination to her family, including her eleven months of age child. She had been negligent to tell her physician that she was doing sport in competition.

Decision
1. The respondent is sanctioned with a period of ineligibility of nine monts, in which she can not take part in competition or manifestations organized or authorized by the FFA and related French sport federations.
2. The period of ineligibility will be reduced by the time already fulfilled by the sanction of the disciplinary committee of the FFA.
3. The decision starts on the date of notification.
4. The decision will be published and sent to the parties involved.

AFLD 2015 FFKMDA vs Respondent M37

Facts
The French Federation for Kick Boxing, Muay Thai and Associated Disciplines (Fédération française de Kick Boxing, Muay Thaï et Disciplines Associées, FFKMDA) charges respondent M37 for a violation of the Anti-Doping Rules. During a Muay Thai and Pankration event on December 6, 2014, a sample was taken for doping test purposes. The analysis of the sample showed the presence of a metabolite of cannabis. Cannabis is a prohibited substance according the World Anti-Doping Agency (WADA) 2014 prohibited list and is regarded as a specified substance.

History
The respondent had been sanctioned by the disciplinary committee of the FFKMDA with a period of ineligibility lasting six months. His obtained results on December 6, 2014, were cancelled. Medals, points and prizes were withdrawn.
The respondent had used cannabis the evening before the doping test in a social setting, there was no intention to enhance sport performance.
The panel regards the use of cannabis as a danger for the respondent and his environment.

Decision
1. The sanction is a period of 9 months of ineligibility in which respondent can't take part in competition or manifestations organized by the FFKMDA and related French sport federations.
2. The period of ineligibility will be reduced by the period already served in provisional suspension and by the period from the decision of the disciplinary committee of the FFKMDA.
3. The decision of the disciplinary committee of the FFKMDA will be modified.
4. The decision starts on the date of notification.
5. The decision will be published and sent to the parties involved.

AFLD 2015 FFB vs Respondent M36

Facts
The French Federation of Billiards (Fédération Française de Billard, FFB) charges respondent M36 for a violation of the Anti-Doping Rules. During a billiard tournament on November 23, 2014, a sample was taken for doping test purposes. The sample tested positive for a metabolite of cannabis and a metabolite of cocaine. Cocaine and cannabis are prohibited substance according the World Anti-Doping Agency (WADA) prohibited list. Cannabis is regarded as a specified substance.

History
The disciplinary committee had sanctioned the respondent with a period of ineligibility lasting one year in which he can not take part in competition or manifestations organized or authorized by the FFB. His results obtained on November 23, 2014, are cancelled. Medals, points and prizes are withdrawn.
The respondent uses cannabis 4 or 5 times a day, he had used cocaine during the two weeks before the doping control. He had used it because of personal problems. There was no intention to enhance sport performance.
The panel took in consideration that respondent voluntarily admitted having consumed cocaine and cannabis, substances classified as narcotics; furthermore, he did not comment, nor produced any documents during the procedure opened against him before the French Anti-Doping Agency (AFLD). His high level of competing and the number and nature of the prohibited substances it is necessary to impose a sanction.

Decision
1 The sanction is a period of ineligibility of three years in which respondent can't take part in competition or manifestation organized by the FFB and related French sport federations.
2. The period of ineligibility will be reduced by the period already served by the decision of the disciplinary committee of the FFB.
3. The decision of the disciplinary committee of the FFB will be modified.
4. The decision will be published and sent to the parties involved.

AFLD 2015 FFA vs Respondent M35

Facts
The French Athletics Federation (Fédération Française d'Athlétisme, FFA) charges respondent M35 for a violation of the Anti-Doping Rules.
Respondent provided a sample for doping control purposes on February 22, 2015, during a test run. Analysis of the samples showed the presence of heptaminol which is a prohibited substance according the World Anti-Doping Agency (WADA) 2015 prohibited list. It is regarded as a specified substance.

History
The respondent had used medication containing the prohibited substance. He had mentioned this on the doping control form. The medication was used for venous insufficiency of the lower limbs. He has a medical statement of is physician and adds he is not an elite-athlete.
The panel is not satisfied with the medical statement of his physician, this statement was related to an earlier period. The panel regards the use as self medication which can be a dangerous act. The respondent had failed in his responsibility to check the ingredients of his medication.

Decision
1. The respondent is sanctioned with a period of ineligibility of one year, in which he can not take part in competition or manifestations organized or authorized by the FFA and related French sport federations.
2. All results obtained on February 22, 2015, are cancelled. Medals, points and prizes are withdrawn.
3. The decision starts on the date of notification.
4. The decision will be published and sent to the parties involved.
