AFLD 2012 FFBB vs Respondent M71

Facts
The French Basketball Federation (Fédération Française de Basket-Ball, FFBB) charges respondent M71 for a violation of the Anti-Doping Rules. During a match on February 12, 2012, a sample was taken for doping test purposes. The analysis of the sample showed the presence of a metabolite of cannabis. Cannabis is a prohibited substance according the World Anti-Doping Agency (WADA) prohibited list and is regarded as a specified substance.

History
The respondent claims the positive test was the result of passive smoking during a festivity.

Decision
1. The sanction is a period of ineligibility of six months in which respondent can't take part in competition or manifestations organized or authorized by the FFBB.
2. The decision will start on the date of notification.
3. The decision will be published and sent to the parties involved.

In July 2012 the National Anti-Doping Commission of Malta has reported an anti-doping rule violation against the Athlete Clayton Failla after his sample tested positive for the prohibited substance ephedrine.
After notification the Athlete was provisional suspended and heard fort the National Anti-Doping Disciplinary Panel of Malta.
The Athlete stated that he suffered from cold and flu and used Dolvan tablets as medication as a remedy when he provided a sample. Also the Athlete argued that he had no intention to play in the competition when his coach choose to let him play although he was reported sick.

The Panel finds that the Athlete suffered from flue and cold at the time of the competition and had no intention to enhance his sport performance. The Panel concludes that the Athlete acted negligently due to using a medication without research of the ingredients, without consulting his doctor and failing to mention the medication on the doping control form.
Therefore the National Anti-Doping Disciplinary Panel of Malta decides to impose a 4 month period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. 20 July 2012.

Mr. Floyd Landis is a professional cylist during the time period from 1999 through 2010 and rode in the professional teams of Mercury, U.S. Postal Service, the Phonak team, OUCH-Maxxis and Bahati Foundation.

Landis admitted the use of Erythropoietin (EPO), human growth hormone (hGH), testosterone and blood doping.
The Athlete testified to USADA about the widespread distribution and use of prohibited substances and methods in the professional cycling teams, his involvement and the involvement of Lance Armstrong, accompliced riders, medical doctors and officials.
Landis provided USADA copies of his emails with conversations and discussions about doping between him, Lance Armstrong and other accomplices.

UKAD 2012 UKAD vs Terry Bridge

In July 2012 the UK Anti-Doping Organization (UKAD) has reported anti-doping rule violations against the rugby player  Terry Bridge for Possession and Trafficking / attempted trafficking of multiple prohibited substances:

  • Boldenone;
  • Clenbuterol;
  • Drostanolone;
  • Growth hormone (GH);
  • Metandienone;
  • Nandrolone;
  • Oxandrolone;
  • Oxymetholone;
  • Stanozolol;
  • Tamoxifen;
  • Testosterone; and
  • Trenbolone.

After notifcation the Athlete admitted the anti-doping rule violations.

Therefore UKAD decides on 26 September 2012 to impose a 4 year period of ineligibility on the Athlete, starting on 6 February 2012.

Mr. Tom Danielson Barry is a professional cylist since 2002 and rode in the professional teams of Mercury, Saturn, Fassa Bortolo, U.S. Postal Service Team, Discovery Channel Team and Slipstream-Chipotle.

Danielson admitted he used Erythropoietin (EPO), testosterone, growth hormone (hGH), cortisone and blood doping.
He testified to USADA about the widespread trafficking, distribution, possession and use of prohibited substances and methods in the U.S. Postal Service Team and Discovery Channel Team, his involvement and the involvement of Lance Armstrong, accompliced riders, medical doctors and officials.

NBB 2012 NBB Decision Disciplinary Committee 2012004 T

In May 2012 the Nederlandse Basketball Bond (Netherlands Basketball Federation, NBB) has reported an anti-doping rule violation against the Person after his sample tested positive for the prohibited substance furosemide.

After notification the Persone filed a statement in his defence and he was heard for the NBB Disciplinary Committee. The Person stated that he used for many years prescribed medication containing the prohibited substance as treatment for his hypertension.
The Committee notes that the Person was also sanctioned in 2011 with a 1 month period of ineligibility imposed by the International Basketball Federation (FIBA) related to the use of the prescribed medication for his hypertension. De NBB Disciplinary finds this a violation under the FIBA Rules and not a violation under the NBB Rules.

Considering the circumstances, with delays in the proceedings and without intention to enhance the performance, the NBB Disciplinary Committee decides on 25 September 2012 to impose a 6 month period of ineligibility on the Person starting on the day of his last competition until 15 October 2012.
Fees and expenses for this Committee shall be borne by the Person.

Ms Polay stated that Betsy was upset after her visit with Mr. Andreu to Lance Armstrong in the Indiana University Hospital on 27 October 1996 where Armstrong was for a cancer treatment. In a full room she heard Lance Armstrong confessing to his doctors that he had used performance enhancing drugs. Also Betsy Andreu shared her concern with Ms Polay about the use of doping by Mr. Andreu as professional cyclist.
