FIVB 2010 FIVB vs Ramon Burgos Mendez

In September 2010 the Fédération Internationale de Volleyball (FIVB), the International Volleyball Federation, has reported an anti-doping rule violation against the minor Puertorican Athlete Ramon Burgos Mendez after his sample tested positive for the prohibited substance cannabis. After notification the Athlete filed a statement in his defence and was heard for the FIVB Disciplinary Panel.

The Athlete admitted the violation and stated that he smoked cannabis at a party 18 days before the doping test and expressed his regret.

The Panel concludes that the Athlete acted negligently without intention to enhance his sport performance.
Considering the principle of proportionality the FIVB Disciplinary Panel decides on 13 October 2010 to impose a 6 month period of ineligibility on the Athlete, starting on the date of the present decisions.

FIVB 2014 FIVB vs Dariam Acevedo

In January 2014 the Fédération Internationale de Volleyball (FIVB), the International Volleyball Federation, has reported an anti-doping rule violation against the Puertorican Athlete Dariam Acevedo after her sample tested positive for the prohibited substance methylphenidate. After notification the Athlete filed a statement in her defence and was heard for the FIVB Disciplinary Panel.

The Athlete admitted the violation and stated she used pills, provided by a student, in support of her exams study. She took the pills in a period she had to cope with the stress of a difficult exam that would determine her professional, post-volleyball career and with the news of her father’s medical condition, which deteriorated dramatically in the same period.

The Panel concludes that the Athlete acted negligently without intention to enhance her sport performance and with exceptional circumstances in her personal, professional and sporting environment.
Therefore the FIVB Disciplinary Panel decides on 7 February 2014 to impose a 1 year period of ineligibility on the Athlete, starting on 30 November 2013.

FIVB 2013 FIVB vs Kyle Caldwell

In October 2013 the Fédération Internationale de Volleyball (FIVB), the International Volleyball Federation, has reported an anti-doping rule violation against the American Athlete Kyle Caldwell after his sample tested positive for the prohibited substance cannabis with a high concentration above the WADA threshold (650 ng/mL). After notification the Athlete was heard for the FIVB Disciplinary Panel.

The Athlete admitted the violation and apologised for his actions. He stated that he smoked frequently cannabis in the two weeks before the doping test due to personal problems. He indicated that he didn’t participate in any competition since the end of the Tournament on 28 September 2013 where he provided a sample.

The Panel accepts Athlete’s statement and concludes that he had no intention to enhance his sport performance but also considers that the Athlete’s degree of fault is high due to the high concentration found in his sample. Therefore the FIVB Disciplinary Panel decides to impose a 1 year period of ineligibility on the Athlete, starting on 29 September 2013.

FIVB 2013 FIVB vs Borja Ruiz Mira

In September 2013 the Fédération Internationale de Volleyball (FIVB), the International Volleyball Federation, has reported an anti-doping rule violation against the Spanish Athlete Borja Ruiz Mira after his sample tested positive for the prohibited substance 19-norandrosterone (nandrolone). After notification the FIVB ordered a provisional suspension. The Athlete filed a statement in his defence and was heard for the FIVB Disciplinary Panel.

The Panel finds that the Athlete could not establish how the prohibited substance entered his body and didn’t even attempt to explain how the prohibited substance could have entered his body and openly admitted that he is unable to explain te positive test result.
Therefore on 8 November 2013 the FIVB Discilinary Panel decides to impose a 2 year period of ineligibility on the Athlete, starting on the date of the notification and the provisional suspension, i.e. on 4 September 2013.

FIVB 2013 FIVB vs Jinling Chu

In June 2013 the Fédération Internationale de Volleyball (FIVB), the International Volleyball Federation, has reported an anti-doping rule violation against the Chinese Athlete Jinling Chu after her sample tested positive for the prohibited substance hydrochlorothiazide. After notification the Athlete and the Chinese Volleyball Confederation filed a statement in their defence and the Athlete was heard for the FIVB Disciplinary Panel.

The Athlete admitted she purchased and used two slimming products in order to loose weight and didn’t know that one of these products contained a prohibited substance due to she could not read the product information on the label written in Thai. Chinese Laboratory analysis confirmed that the substance hydrochlorothiazide was found in the Thai slimming product.

The Panel considers that the Athlete had not intention to cheat or to mask the use of a substance to enhance her sport performance. Also the Athlete was at fault due to she purchased online in Thailand and Japan products to lose weiht without consulting her support personnel.
Therefore the FIVB Disciplinary Panel decides on 10 July 2013 to impose a 14 month period of ineligibility on the Athlete, starting on 6 May 2013.

FIVB 2012 FIVB vs Kumar Umang

In July 2012 the Fédération Internationale de Volleyball (FIVB), the International Volleyball Federation, has reported an anti-doping rule violation against the Indian Athlete Kumar Umang after his A and B samples tested positive for the prohibited substance 19-norandrostenedione (nandrolone). After notification the FIVB ordered a provisional suspension. The Athlete submitted a medical prescription without further explanations in his defence and he failed to be heard for the FIVB Anti-Doping Hearing Panel.

The Hearing Panel has serious doubt about the authenticity of the prescription, submitted by the Athlete, which also doesn’t explain the prohibited substance found in his sample.
Therefore the FIVB Anti-Doping Hearing Panel decides on 28 November 2011 to impose a 2 year period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 31 july 2012.

FIVB 2011 FIVB vs Nataliya Chernetska

In September 2010 the Fédération Internationale de Volleyball (FIVB), the International Volleyball Federation, has reported an anti-doping rule violation against the Ukrainian Athlete Nataliya Chernetska after her sample tested positive for the prohibited substance furosemide. After notification the Athlete filed a statement in her defence and was heard for the FIVB Anti-Doping Hearing Panel.

The Athlete stated that she suffered from swellings during airflights and therefore used the free available product Furosemid-Darnitsa. She didn’t know the product contained a prohibited substance and she used it two days before the doping control.
The Hearing Panel considers that the Athlete had no intention to cheat and that she was at fault due to she failed to research the ingredients on the label of the product before using it and without consulting any doctor.
Therefore the FIVB Anti-Doping Hearing Panel decides on 4 November 2011 to impose a 18 month period of ineligibility on the Athlete, starting on the date of the Athlete’s last competition, i.e. on 26 September 2011.

FIVB 2010 FIVB vs So-Jin Lee

In September 2010 the Fédération Internationale de Volleyball (FIVB), the International Volleyball Federation, has reported an anti-doping rule violation against the Korean Athlete So-Jin Lee after her sample tested positive for the prohibited substance formoterol. After notification the Athlete filed a statement with medical documentation in her defence.

The Athlete submitted she suffered from asthma and other allergic conditions since 2008 and therefore used the prescribed medication Symbicort (formoterol and budesonide).
The Athlete stated that the WADA TUE rules for asthma was on the process of revision and that a system of retroactive TUE was available in case of an Adverse Analytical Finding. Also for the competition they had no team medical doctor present and she didn’t mention her medication on the Doping Control Form due to her limited understanding of the English language.

The FIVB Panel concludes that the Athlete acted negligently without intention to enhance her sport performance due to her asthma. Considering the principle of proportionality the FIVB Anti-Doping Hearing Panel decides on 14 October 2010 to impose a 9 month period of ineligibility on the Athlete, starting on the date of the Decision.

FIVB 2010 FIVB vs Sirianis Mendez Hernandez

In February 2010 the Fédération Internationale de Volleyball (FIVB), the International Volleyball Federation, has reported an anti-doping rule violation against the Cuban Athlete Sirianis Mendez Hernandez after his A and B samples tested positive for the prohibited substance pseudopephedrine. After notification the Athlete filed a statement in his defence and was heard for the FIVB Anti-Doping Hearing Panel.

The Athlete stated that he suffered from asthma since childhood and therefore use prescribed medication and also received the appropriate TUE when he played in Cuba.
Contracted in Poland the trainer told him that the club doctor would apply for the appropriate TUE and he didn’t know that the substance pseudoephedrine, ingredient in his medication, was entered in het new WADA 2010 Prohibited List.

The Panel finds that the Athlete should have reviewed the WADA 2010 Prohibited List before using his medication but due to his asthma he also had no intention to enhance his sport performance,
Considering the principle of proportionality the FIVB Anti-Doping Hearing Panel decides on 13 September 2010 to impose a 3 month period of ineligibility on the Athlete, starting on 17 August 2010.

FIVB 2010 FIVB vs Gregory Berrios

In June 2010 the Fédération Internationale de Volleyball (FIVB), the International Volleyball Federation, has reported an anti-doping rule violation against the Puertorican Athlete Gregory Berrios after his sample tested positive for the prohibited substance N-Didesmethyl sibutramine. After notification the FIVB ordered a provisional suspension. The Athlete filed a statement in his defence and was heard for the FIVB Anti-Doping Hearing Panel.

The Athlete stated that, due to a knee injury, he gained weight and therefore he used a natural product “Fat Loss”. He showed the Panel that the productlabel didn’t mention it contained prohibited substances.

The Panel concludes that the Athlete had no intention to enhance his sport panel but also acted negligently due to he used a dietary product on his own initiative without prescription or advice of competent expert or the team doctor.
Therefore the FIVB Anti-Doping Hearing Panel decides on 4 August 2010 to impose a 3 month period of ineligibility on the Athlete, starting on the date of the provisional suspension, i.e. on 13 July 2010.
