ISR 2010 KNMV Decision Disciplinary Committee 2010039 T

The Royal Dutch Motorcyclists Association (Koninklijke Nederlandse Motorrijders Vereniging, KNMV has reported an anti doping rule violation against this person after he tested positive for the prohibited substance benzoylecgonine (a metabolite of cocaine).
KNMV notified the person of the doping violation and ordered a provisional suspension. Person filed a statement in his defence and was heard for the Committee.

The Person admitted he had used cocaine at a party a few days prior to the doping control without intention to enhance his performance. Without mitigating circumstances the Disciplinary Committee decides on 15 September 2010 to impose a two year period of ineligibility starting on the date of the provisional suspension. Fees and expenses for this committee shall be borne by person.

ISR 2007 KNKF Decision Disciplinary Committee 2007068 T

The Royal Netherlands Power Sport and Fitness Federation
(Koninklijke Nederlandse Krachtsport en Fitnessfederatie, KNKF)
reports defendant for not attending an out of competition doping test. The defendant filed a written defence on November 17, 2007. The defendant didn't attend the oral hearing on December 17, 2007.
In writing the defendant claims he is not a member anymore of the KNKF. The Committee agrees because he ended his membership in time.
The defendant is free of charge, all the expenses are for the KNKF.

ISR 2010 NHB Decision Disciplinary Committee 2010051 T

The Dutch Archery Association (Nederlandse Handboog Bond, NHB) has reported an anti doping rule violation against this person after he tested positive for the prohibited substance
11-nor-∆9-tetrahydrocannabinol-9carboxylic acid (a metabolite of cannabis).
NHB notified the person of the doping violation and ordered a provisional suspension. Person filed a statement in his defence and was heard for the Committee. Person stated he had smoked a joint one week prior to the anti-doping test because of stress and had no intention to enhance his performance. His statement was supported by witnesses.
The committee accepts person’s statement and, with exceptional circumstances, decides to reprimand person with ineligibility for the provisional suspension.

ISR 2010 KNWU Decision Disciplinary Committee 2010074 T

The Royal Dutch Cycling Federation (Koninklijke Nederlandse Wielren Unie, KNWU) has reported an anti doping rule violation against this person after he tested positive for the prohibited substance clenbuterol in the A and B samples.
Person was tested before without problems and the concentration clenbuterol in the samples was very low.

Person was heard for the committee and stated the positive test results were caused by clenbuterol contaminations in meat during his stay in Mexico prior to the anti-doping control. His statement was supported by literature about the illegal use of clenbuterol in the Mexican food industry. Person’s travel report showed he had been cautious with food during his stay in Mexico to avoid contaminations.

The Disciplinary Committee considered person’s statement acceptable and decided to acquit person of violation the Anti-Doping Rules without sanction. KNKF should bear half de cost, made for person’s defence.

NWWB 2007 NWWB Decision Disciplinary Committee 2007060 T

Facts
The Dutch Waterski and Wakeboard Association (NWWB) reports a violation of the Anti-Doping Code. On July 21, 2007 during a wakeboard championship the defendant was tested positive for a metabolite of cannabis, 11-nor-Delta(9)-tetrahydrocannabinol-9-carboxylic acid.
The defendant attended the oral hearing on October 8, 2007, he declares that he didn't know a joint would be in his blood for a longer period. Information about prohibited substances didn't arrive at his residence due to an error in the administration of the NWWB. He didn't participate in the European Championship on August 20, 2007.
The Defendant didn't use the substance to enhance his sport performance, however the substance is prohibited.

Decision
The Disciplinary Committee decision is a warning and reprimand, the results of the championship will be disqualified.

The Person appealed the decision of the Royal Dutch Korfball Association (Koninklijk Nederlands Korfbalverbond, KNKV) rendered on 10 May 2011 for his refusal to cooperate to Doping Control.

The Person asserted that he didn’t refuse to the DCO, he was misinformed about the Doping Control. Prior he had received insufficient and confusing information from the organizations about the whereabouts and the one-hour-timeslot.

The Appeal Committee considered the issued information and education in question and concludes that the Person indeed didn't refuse to cooperate to Doping Control as a result of miscarriage of justice.
Without the Person's fault the Committee deems that the imposed sanction was disproportional. Therefore KNKV Appeal Committee annuls the KNKV decision of 10 May 2011 and decides to impose only a warning on the Person.

ISR 2007 KNKF Decision Disciplinary Committee 2007044 T

The Dutch Royal Strength Sport Fitness Federation (KNKF) reports a violation of the Anti-Doping Code. A doping test on April 29, 2007, showed the presence of the substance formoterol, this is a prohibited substance according the Anti-Doping Code section 3 of the ISR and recognised by the KNKF.
The defendant didn't want to send a written defence or attend a oral hearing, the case was handled in writing. He did present a dispensation request and a medical statement from his general practitioner.
The Disciplinary Committee is qualified to handle this case, the procedure of testing was handled correctly.
The Award is a warning and a reprimand, a fee is settled.

The Royal Dutch Korfball Association (Koninklijk Nederlands Korfbalverbond, KNKV) has reported an anti doping rule violation against the Person after he refused to cooperate to doping control in January 2011.

The Person was tested in the period prior to 1 January 2001, during in and out-of-competition, at different times and locations.
The Person’s situation changed after 1 January 2011 when he became part op the Registered Testing Pool with the obligation to report his whereabouts and one-hour-timeslot.

Person stated that it was difficult to find relevant information, while the information he received from the KNKV, the Anti-Doping Authority, the DCO and the IKF was insufficient and confusing. As a result the Person assumed that his cooperation was only necessary within the one-hour-timeslot.

The Committee deems that the insufficient information was highly responsible for the Person’s confusion as to his obligations.
The Committee rejects the Person’s assertions regarding his cooperation to anti-doping control and the violation of the privacy legislation.

Because of the exceptional circumstances in this case the KNKV Disciplinary Committee decides on 10 May 2011 to impose a 1 year period of ineligibility on the Person.

Fees and expenses for this committee shall be borne by the Person’s korfball club.

NIJB 2007 NIJB Decision Disciplinary Committee 2007031 T

Facts
The disciplinary committee of the Dutch Ice Hockey League (Nederlandse IJshockey Bond, NIJB) reported a violation of the Anti-Doping Code. The defendant's sample showed a metabolite of the substance finasteride. It is prohibited to use this substance in and out of competition.
During the oral hearing on July 18, 2007, the defendant declares that he is unaware how the substance has entered his body. One month earlier his sample tested negative.
The substance is on the prohibited list, however it is not a specific substance.

Decision
Because the defendant has no explanation about the origin of the substance the award is set to a ineligibility period of 2 years. A fee is settled, an appeal can be made within 14 days.

NIJB 2011 NIJB Decision Disciplinary Committee 2011003 T

The Netherlands Ice Hockey Association (Nederlandse IJshockey Bond, NIJB) has reported an anti doping rule violation against 2 players after their samples tested positive for the prohibited substance methylhexaneamine (dimethylpentylamine) during two separate anti-doping tests.
Players stated they didn’t know they used a supplement containing a prohibited substance because the label of the supplement did not mention it as ingredient.
The committee accepts the statement of the players as mitigating circumstances. Therefore the players had no intention to enhance their performance. The committee concludes that the players didn’t make further inquiries about the ingredients in the supplement and decides, because of exceptional circumstances, for a period of ineligibility until October 1, 2011.
